Cancelling upgraded contract

I am currently trying to cancel a contract with 3 but I am having a couple of difficulties with them.
Firstly, 3 are saying I am in a contract until October 2010. My original 18 month contract started in October 2007 and I received an upgraded phone in March 2009 for another 18 months. I think the new contract began then but 3 say it didn't start until April 2009. Are they right?
Secondly, they are insisting that I need to call them again to cancel for "administrative purposes". As I have already called and written to them expressing clearly my wish to cancel my contract, can I continue to insist that I have given them the required legal notice?

You upgraded before the end of your first contract, but with Three your new contract does not start till your old contract ends.
so 18 X 2 = 36 months
October 2007 to October 2010 = 36 months.Laters

I thought that the upgraded contract would begin from the time I received my upgraded phone, not a month later. Are 3 out of step with other companies or is this usual industry practice?0 -
In Three's T&C's it says that, when you upgrade, any difference in tariff will start the next billing month, but the new contract term starts at the end of the old contract.
It's a pain...

Industry practice I believe. Orange did it with me some time ago.
For your own sake, whether or not 3 are right or wrong about you having to cancel again, please do it. This forum is littered with threads from people who thought they cancelled or tried to cancel, then cancelled their DD only to be pursued months/years later by debt collectors.
So, go through the hoops, do not cancel your DD till a couple of months after what you think is the last payment (there may be late charges).
It is easier to reclaim through MCOL if it comes to that for money taken when not due than to get the black mark off your Credit Record.0 -
well i upgraded on t mobile recently to a higher tariff they started charging me the higher tariff from month 18 of my previous tariff which meant my old tarrif only last 17 months and this one will last 230
