    Hi,

    Apologies if I have missed something in someone else's reply. I don't think you have lost out at all. First "sold as seen" is not permited under the CPR's (Consumer Protection from Unfair Trading Regulations) this practice needs to be reported to trading standards (via Consumer Direct). Second - traders (garages included) CANNOT exempt themselves from giving you your rights under the Sale of Goods Act (again if they do or try to it is a potential offence under CPR's).

    Write to the trader outling your issues and requesting that under the SoG Act they rectify the matter (template letters on Consumer Direct website). If they refuse then small claim court is only recourse. Consumer Direct website/callcentre can advise further. (Google consumer direct)

    It is true that the SoGA does apply, but the problem is whether or not it is reasonable for a 13 year old to need the above items replaced or not. If it is reasonable for the bearings and valve to go after 13 years, then it is up to the customer to replace them.

    Jus got thru 2 dealer, she said it was sold as a trade, she not spending money on a wee car of that cost r age, she has told me 2 see her and she will give me my money back, i mentioned trading standards and soga, dont tink she wanted any of this legal stuff lol, Heard other stories that they have been done b4, so mayb she didnt want any of it.

    I seem to be able to make out that the dealer has offered your money back. Take it and be a little more careful next time.
