I've got no baliffs, no DCA's, no monsters, no ghosts and no spiders... But I've currently I've got my darling other half and his, er, how can I put this, post-curry digestive troubles... Wanna swap? :rotfl:I refuse to be afraid of the big bad wolf, spiders, or debt collection agencies; one of them's not real and the other two are powerless without my fear.
(Ok, one of them is powerless, spiders can be nasty.)
As of the last count I have cleared [STRIKE]23.16%[/STRIKE] 22.49% of my debt.

Gordon you behave yourself wont you or I'll send Mr Dreamboat round to yours- floaters and all!I refuse to be afraid of the big bad wolf, spiders, or debt collection agencies; one of them's not real and the other two are powerless without my fear.

right ok, ill wait until i have got been able to check my credit file and come back on here then
just a quick question r.e. debt collectors/bailiffs, does it sound more like bailiffs or debt colloctors, to wait out side a property for nearly 2 hours and knock on a few houses around the street (no one answered the door) but to persistantly knock on my neighbours door?
thanks for all your help so far0 -

Depends how much work they have on I suppose.
Did the tow truck turn up for the car they were threatening to take?
If not, chances are the are just debt collectors, and have no authority to enter your house, let alone remove your property. If debt collectors do turn up, ask them to put everything in writing, don't entertain any sort of conversation with them.
If it's Bailiff's, well...they are allowed to remove your goods, and are appointed by a court.0 -

no, nobody turned up with a tow truck, they just left about 50 minutes after threatening that.
also i thought, i didnt have to allow bailiffs in my home, but if i left a window open etc they could gain 'peaceful' entry, but werent allowed to push past me etc.0 -
I suspect they were just debt collectors throwing around empty threats.
I believe bailiffs can push past you. Not 100% sure though.0 -

Gordon you have a really low view of consumer rights, poor thing, I bet you get ripped off quite a bit eh.
Baliffs can't push past you, it's using force, they have to gain PEACEFUL entry- not forced. There's a chap who comes on here who used to be a baliff and stays up to date on the rules and a lady who practically wrote the definative guide on baliff rules... In fact when I come to think of it there's quite a lot of people with very detailed knowledge of baliffing, knowledge Gordon and I don't have. Making a new post titled questions about baliffs or something like that ought to get the right people looking. If you didn't appear on http://www.trustonline.org.uk/ you haven't got a CCJ and therefore you wont have a baliff looking for you.
Even if a baliff has been assigned to a debt doesn't mean they can take your things, they have many rules governing them, it's not just a case that they can turn up and loot stuff, there's a lot more to it than that.
As to if they were debt collectors or baliffs, how about just asking the neighbours? Either might make threats they don't keep (especially if they think you're in and they want you to answer) and either can look intimidating and official. Corn snakes look just like milk snakes too- one is a harmless kids pet and the other is seriously venomous. Both with snakes and debt collectors it is that way deliberately! Neither need bother you however, you will learn more about this as you go along. Read other posts in the mean time for a kind of background reading and general upping of your savviness.
Speaking of general info, I read back to your posts on page one. You might like to know that most of the time a debt is being persued by a DCA they do not own it. In fact thier owning it is quite rare and tend to happen quite late on, usually years after you first defaulted and some time after you've had letters from a few different DCA's on the same debt. Only when the CC company has given up all hope that you can be hounded into paying will they sell because they only get 20% of the face value in doing so. Of course there are always exceptions, but generally that's how it goes. Any debt in dispute can't be sold on or be increased though, so if you aren't sure you're liable or you dispute the actual amount, or even that you're just not sure the amount is right then you have a bit of leeway to sort it out.I refuse to be afraid of the big bad wolf, spiders, or debt collection agencies; one of them's not real and the other two are powerless without my fear.

I don't get ripped off at all, as it happens. Not sure where you got that from.
Debt collectors will be armed with a few threats, nothing more. Tell them to jog on.
Bailiff's will be armed with a warrant that allows them entry into your home to remove goods, if you prevent them from entering they can call the Police, who do have the right to smash your door in if you keep refusing entry.
There's no point sugar coating the process.0
