A&L Problems - PPI

Hi,

I've been trying for many months, to extract a copy of a loan agreement which ended in November 2004, as I was looking to make a PPI claim for miss-selling.

Despite receiving a letter from A&L confirming that they couldn't provide any loan information, (despite being within 6 years of completion), I moved forward with my claim.

To back up my claim, I submitted a copy of my Experian Credit Report, which lists the loan in question, but no reference number.

After many subsequent replies from A&L, it now appears that their stance is, that without the Loan Reference Number, I cannot persue my claim.

Has anyone else found a way through this system? It sure seems crazy, that as they cannot comply with the Data Protection Act, I should be prevented from making my case against them.

    Hi Graham & welcome

    How annoying that is for you.

    Have you any old banking statements which would show the loan account number next to the monthly repayments?

    If you bank with the same bank now and do online banking this should allow you to go back up to about the last 7 years.

    Otherwise contact the Information Commissioner office (ICO) for some advice on where to go on this one.

    I do still bank with them, so I'm away now to request an old bank statement, which hopefully will show the detail.

    Hiya Graham I didnt have an account number and my loan was in 2004, Try emailing [EMAIL="LetsWorkItOut@alliance-leicester.co.uk"]LetsWorkItOut@alliance-leicester.co.uk[/EMAIL]
    Or just write without giving as much detail asking for a copy of your credit agreement , I sent a letter asking without the £1 and got a copy with an offer soon after.

    Having requested and being told by Santander that they could provide copy bank statements for the period June 2003 - December 2004, I requested copies for the cost of £10. Now despite many repeated promises (4 chasers) of having sent them out to me, I today received a one page summary sheet for the period in question. It had no transaction history at all. Completely useless piece of paper. I cannot understand how someone thought that would assist anyone!

    I've now called them to voice my disgust at their performance, and was initially advised that I was misinformed by the previous 4 Customer Service Advisor's (due to lack of training!) as they could only go back for a max of 5 years. This was retracted very quickly when I advised them of their obligations of holding 6 years history. They are now looking in to the matter but it could be a further 6 weeks before they can respond. Santander certainly appear to be completely incompetent!

    Now away to plot my next move.

    That is a lot to pay out just for that!

    I personally would have gone the SAR direction, you pay the same but they supply everything on the account they still hold, also with statements.
    If you did not actually request as a SAR, you could send them the letter template and confirm you have already made the adequate payment.
    However, this can take up to 40 calendar days, I would not enclose another payment though and again confirm a payment have been made and debited for your data and you would like them to send all they still hold on your account as requested for on the Subject Access Request (SAR).

  • Well the package from A&L (Santander) finally arrived today. Hooray! Well only till I opened it, and scanned the contents.

    They have provided copy bank statements going back to April 2004. Problem is that for each months bank statement, they've only given me the last page of statement. So all the info that I need, has not been provided, since all my DD's etc. Generally get taken at the beginning of the month. What a disappointment. No other information was supplied, despite asking for it.

    I've been back on to them to complain, and initially again been advised that they only hold the information for 5 years, however, when challenged they retract the statement and offer to re-issue the statements again. No offer for any of the other info.

    I'm starting to believe that Santander have a serious problem with their Data Protection procedures.

    Not sure where I go now. All I'm aiming to get is the reference number of an old A&L Personal Loan which was paid off in Nov 2004, to allow me to check my PPI information.

    Anyone experienced the same issues?

    they have a legal obligation to keep all data and statement information ofr 6 years so they should have it,
    ask them for all of the information, tell them you will be making a complaint to the ICO and the FSA if they have not kept this information and supply it to you.

    they are in a serious breach of the data protection act if they have not got/won't disclose this information.
