private car clamping to be abolished.

    For example, they could park their clamping van across the car park entrance (on the private land side) and refuse to move it unless £XXX was paid.

    In Scotland this would be seen as extortion and theft (what clamping is regarded as north of the border), so if the courts in england/wales took the same stance it would also be illegal.

    Sincerely hope that 'deliberately blocking in' would be viewed as illegal immobilisation as well.

    Errrrr, no Daily Mail, that's not the sanction that applies to public roads or council car parks if you don't pay! Visit from a bailiff or Small Claims indeed! Have they not heard of parking tickets and appeals and adjudicators (with most appeals to adjudicators being upheld?).

    OK, we won't, but I presume you realise that private parking tickets are not enforceable and highly unlikely to suddenly become so!

    Even if there are some changes to regulate firms then TBH that wouldn't be a bad thing if it meant that those sad uninformed victims who actually pay are not charged extortionate amounts.

    And those of us who can see any 'ticket' for what it is will still not end up paying it.

    I cannot see the clampers taking this with good grace, and will no doubt find some very nasty tricks to get round this.

    For example, they could park their clamping van across the car park entrance (on the private land side) and refuse to move it unless £XXX was paid.

    Where would the law stand on that - and even more so, would the police bother to turn up and take the motorists side in this circumstance - or would the motorist have to pay under pressure and resort to the courts to claim this back - in much the same manner as getting back clamping fees illegally obtained?


    I reckon a sharp increase in charges will happen very shortly to cover them going out of business

    I know from my own experience they are not. Last year we parked too long at a retail park. We were awarded a parking ticket and just ignored all the correspondance that went with it. We never contacted them and eventually they gave up.

    I do hope you are right and that they remain unforceable. If not then the clampers will seek revenge that way.
