private car clamping to be abolished.

However if you receive a parking ticket on private land it will be enforceable as if issued by the Police or council officials. No doubt these clampers will make up their revenues that way.

Who says it will be enforceable? If it looks like a duck, and quacks like a duck, we have at least to consider the possibility that we have a small aquatic bird of the family anatidae on our hands

That will have to somehow override civil law dealing with trespass and contract. I can't see that working somehow. What part of "A whop bop-a-lu a whop bam boo" don't you understand?0 -

Me thinks someone was watching The One Show last night and misheard what they were saying...If it looks like a duck, and quacks like a duck, we have at least to consider the possibility that we have a small aquatic bird of the family anatidae on our hands

Well me thinks you are wrong.
QUOTE
Private car parks will still be allowed to charge motorists a fee, using ticket machines. But they will have to sign up to a strict code of conduct agreed by the British Parking Association (BPA). All signs about charges must be clear, and any fees for over-staying must be 'reasonable'. Crucially, there will be a right of appeal to an independent tribunal with the power to quash unfair charges.Any motorist who refuses to pay will face the same sanction that applies to public roads or council car parks, which is a visit from the bailiff or a trip to the small claims court.
UNQUOTE
I bet you didnt see that coming!

All I can say is define "reasonable". And there will have to be a major change in the law to override the long-standing civil law that deals with contract and trespass. What part of "A whop bop-a-lu a whop bam boo" don't you understand?0

Are we believing things that are reported in the Daily Mail now?
And that only refers to car parks where there is a charge. It doesn't mention the private land etc where there are signs but no cost for parking. Unless they are going to review the laws regarding contracts as well...If it looks like a duck, and quacks like a duck, we have at least to consider the possibility that we have a small aquatic bird of the family anatidae on our hands

Rupert Bear you actually believe what it says in the Daily Mail?
This bit isn't even true of Public Highway parking, let alone private land:
'Any motorist who refuses to pay will face the same sanction that applies to public roads or council car parks, which is a visit from the bailiff or a trip to the small claims court.'
Errrrr, no Daily Mail, that's not the sanction that applies to public roads or council car parks if you don't pay! Visit from a bailiff or Small Claims indeed! Have they not heard of parking tickets and appeals and adjudicators (with most appeals to adjudicators being upheld?).
:rotfl:PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

I cannot see the clampers taking this with good grace, and will no doubt find some very nasty tricks to get round this.
For example, they could park their clamping van across the car park entrance (on the private land side) and refuse to move it unless £XXX was paid.
Where would the law stand on that - and even more so, would the police bother to turn up and take the motorists side in this circumstance - or would the motorist have to pay under pressure and resort to the courts to claim this back - in much the same manner as getting back clamping fees illegally obtained?0
