Can I sue my landlord?

    The outcomes in recent non protection of deposit cases have been, to say the least, less than consistent. Untill we have a decision from a higher court on a case like yours, there will be no definitive answer. But so far, there seems to be the attitude that the LL is given some slack, depending on his intent regarding the deposit. Obviously, by returning it, he has shown his intent was not to withold it against the purpose of the current legislation. My personal feeling is that you would be wasting your time and efforts. But this is just my opinion and the choice is, of course, yours. You had far more protection with regard to the notice, which is a shame.
  • Thank you, I think I will leave it. This summer has been stressful enough without adding to it with this i guess. I had no idea that he had to give me 2 months notice, which is a shame. I should have looked up my right as a tenant.

    I hate landlords.

    Yes this is in England, and as harsh as it sounds, even if i get my 400 pounds back, i still want to sue him for the hassle and stress he has caused me throughout my stay, especially in the last month. I was living with two other girls, ever since they moved out, he has been rude, coming in when he likes and forcing me out early. I know this all sounds very cash grabbing but I dont care, i just want to know my options.

    I am not sharing with my landlord no, he is using the boyfriend excuse to get me out early.

    I am moving out in 4 days time to another property yes, the contract was meant to end on the 1st of september anyway.

    As I understand this you are being intimidated out of the property and this is covered by the protection from Eviction act.

    Have a good read of it. Im certain it applies to you so I would speak to shelter to take further advice.

    The LL can put what he likes in a Tenancy Agreement but there's no guarantee it will stand up in court. It's LL& T law that defines things, not a random clause popped in to a self drafted/adapted tenancy agreement

    Twaddle, twaddle.. No jury, no fine. Civil law not criminal law. Don't flag up your experience as a LL and then spout rubbish. It makes you look foolish.

  • He has been a poor landlord, but is accusing me of breaching my contract by letting my boyfriend stay over with me. He has seen him here twice, and the first time he told me he had no problems with him staying. The second time, he changed his mind, and gave me four weeks to move out.

    I feel as though he has bullied me out of the house by saying I have breached my contract. Have I breached it?
