I sent cheque but seller is saying they haven't received it!

  • Sorry for the negativity but trying to negotiate after the sale is breach of contract - when you bid you make a contract.

    You are agreeing to a contract -- You will enter into a legally binding contract to purchase the item from the seller if you're the winning bidder. You are responsible for reading the full item listing, including the seller's instructions and accepted payment methods. Seller assumes all responsibility for listing this item.

    The may be messing you around because you have messed them around! It is not right but you cannot prove they have received it and perhaps they haven't received it - think from their point of view then - highest bidder first of all starts querying the price and then doesn't send a cheque - they could quite easily start npb prcodeure against you - if they really haven't received the cheque then it is equally dodgy from their point of view

    I know some people are quite rude on here but hopefully this is just good advice! And I dont mind all the !!!!!

    But you asked after you had bid and won. That is not the way it goes. If you don't like the terms of the auction you contact the seller before bidding or walk away from it.

    But your failure to pay the advertised P&P was probably the cause of your problems.

    The seller sent me the items in the send for the £6 postage he was trying to charge me it was £1.36 icon9.gif So I was right to query it! The auction for the DVD had a name in the title which wasn't the person in the DVD! I wouldn't know cos it was for my lil sis! so he was deceitful!! am just thinking of what neg to leave! icon12.gif

    ........."Tried to Charge £6 for £1.36 P&P agreed to £4! deceitful auction title, unfriendly comms".......

    Angel, be careful about highlighting the post and packing charges in the feedback. When I have been checking through feedback left and received and see someone moaning about excessive charges I tend to check the auction if it is still available. If it doesn't show p and p I would make the assumption that the buyer is in the wrong and probably block them from bidding on my auctions in case they are just 'difficult' buyers.

    If you really feel you need to leave a neg, and I don't think I would in this case, then word it carefully so it doesn't make you look bad. Also remember that they can respond and possibly do you more damage than you can do them.

    also what were they posted in? if the packaging was new and bought specifically for posting your items then the seller can charge for it, if it gets sent in secondhand wrapping that's just been recycled that's cheaper, but packing materials are expensive ... i wouldn't know though, i always recylce lol!

    They have already left me positive feedback!

    I was in a bad mood then - when I said about the neg! I shall re-think about what I put! the P&P is in the auctions, Maybe I will just leave it! .....but then again the case of one of the dvd's was broken! it didn't hold the disc! icon12.gif they only have 39 feedbacks so it would dent it quite a bit!
