Refusal from BOS..Need help Pls

Hi My husband had a creditcard with the Bank of scotland, it was a postal application, he ticked the PPI section as he was thinking that it was necessary to apply for credit card, after we made the complaint abt mis-selling the PPI, the Bank has written him that it was his own choice, he purchased it without getting any advice from them, he wrote back saying that they didn't make it clear that it was optional, not they have written him back , enclosing a copy of the original application filled by him, saying as it was his own choice and responsibility, they are declining the complaint...
Someone please let me know if we have a chance of fighting? should we write to the Bank again? or better to complain to the Financial ombudsman?:mad:

    Was this the final response?
    If so did they enclose any details of the FOS?

    If not final the final decision, maybe he could write back again and make it clear that he is aware that banks/businesses are being punished by the FSA for not investigating complaints properly and for rejecting genuine complaints, and he does not feel they have even considered his reasons he have given,
    Ask that they get back by 14 days, and if you hear nothing then you will proceed this complaint with the FOS with the reasons he have.

  • Hi there, they didn't say it was their final response. they said he chose it himself without taking advice from them, they have also enclosed a copy of the postal application where he ticked and signed for the PPI....are you saying if he write to BOS again he may have a chance?

    This is standard.

    Write back as stated on my above post.

    At the end of the day - they need to take his reasons into account, they always send a copy of the agreement as standard in hope you won't bother again, but he has his reasons, keep at them.;)
    He may have assumed the ppi was all part of the policy, basically because it was not explained to him, if it was then he would have opted out, tell them that.

  • You are right. its our money, time to sort them out. Thanks a lot for your help DI...If we just stand by saying that they did not state on the policy that it was optional, more over my hubby never ever re'd the policy details..

    Your hubby should have received the policy details, then maybe he would have known more about the policy, so yes tell them that too.

    This is another Lloyds TSB creditcard which my hubby has. they wrote back saying they are willing to refund from Dec 99 till Mar 2001, I do not understand y they want to refund uptp march 01 rather than up to now,,,they have incomplete record of upgrading the card. we are happy that they are willing to refund but very cross and annoyed that y they cant refund upto now???

    That is strange......

    So I take it that this card is still active?

    If this is the case and your hubby is still paying out for this, then surely they should refund up to-date.

    Just a suggestion, but have you tried requesting for a SAR (Subject access request) from their data dept?
    They have 40 calendar days to comply and send all the info held on the account.
    However, for this request you enclose £10 cheque or postal order.

    Yes it is still active. we were so confused when we saw the letter. no we haven't requested for SAR

    That is so strange isn't it?

    Its up to you if you want to request for a SAR, but you never know, something useful may come back within to help your case.;)

    BOS ...complete and utter liars..dont believe a word they tell you, dont even bother trying to reason with them just go right to FOS .. ..FOS are investigating them for fraud on my behalf:beer:
    HBOS charges..£7000.00 recieved.
    Egg cc..£1300 recieved.
    Barclaycard cc..£ 568 recieved.
    A&L loan..£1677 recieved..HBOS cc..£3500. HBOS.. loan £919.HBOS.cc charges. £1400 MPPI £21799 recieved
