    But would that have been done with the OP's permission, whilst i have no doubt thats how dsg operates, it does put them up the creek in an incident like this as theyre doing it on the assumption that the customer is happy with a refund.

    All i can see is that the OP os perfectly entitled to their item back or to sue for expectation loss and have a same/similar spec satnav without spending extra.

    They are offering to put the customer back in the position they were in before with a full refund - don't see whats unreasonable about that. The OP never "rejected" the goods as unfit for purpose, just went in seeking a resolution.

  • Esqui was spot on regarding the model; it was a Tom Tom Go 630. It sounds like this was a common problem with this model.

    I purchased the item from the Currys website and when I called them about the faulty charger I asked if I could just exchange the charger at my local Currys store (just as Esqui appears to do for his customers) but I was told this was definitely not allowed, but not to worry I would get a replacement within the week.

    Esqui says that technically, by returning the item, I had agreed to exchange it for ‘an item on order’ that may not be in stock. However, this was never explained to me and if it had then I would never have returned the item. Currys claim to record all the telephone calls and, if this is true, they will have the evidence that I was promised a new device within the week and that any other terms and conditions were not mentioned.

    Unfortunately I said that I wanted my item back and not a refund, and so the Currys head office lady, after laughing at me, agreed not to give me a refund. So now I’m left without a Sat Nav or my money wondering what to do next.

    Yeah, I think it may be. Already fed it back to TomTom.

    I don't know if you agreed to that, but it's what the store would have had to do to generate the order for the new one.

    I'd go back in and see if there's any local stores who have one, or if they can do a deal off another one that's similar (as I said earlier, the 730 was a replacement deal for it at £179)
