:oI was wondering if anyone could give me help/advice im new to this site so apologies if you've seen this kind of thread before
I recently took a contract out with orange but the phone is very bad looses signal vibrates when it feels like it also turns itself off
since noticing these problems i read some reviews about the phone and a few people have had these problems and got bad ratings
when i spoke to orange they said i can get the same phone again but i don't really want this as other people have said it has problems
i don't want to cancel the contract i just want to swap phones anyone know my rights on this???

How did you buy the phone, online, store?
What sort of phone is it?
Have you tried another phone with your sim to rule out the network as the reason being the call performance?0 -
If orange are the same as vodafone then they will usually only swap a phone for the same model.
If you are out of the first 14 days or whatever it is with orange they will not let you cancell anyway0 -

It's the sony erricson vivas, I got it online

Ok, so it's the phone then. After your 7 days distance selling rights then no, you cannot swap the phone.
If you think it's faulty (vibrating randomly would suggest it) then call them and arrange for the phone to go for repair, or a swap out if it's new.
If the replacement phone is exhibits the same fault then you can ask them, but they are not obliged to exchange the phone - although they may choose to do so.0 -

If the phones faulty it won't go away for repair, they'll courier you a new one and swap it over on your doorstep, they won't swap it for a different model unfortunately but my advice would be to get the replacement then flog it on eBay while it still has some value and put the proceeds towards a phone of your choosing0
