Who on earth is my argument with?!

Hi.

In brief, just returned from a 2wk s/c hol in Crete. Upon arrival, at 2am, we found our accomm complex closed down for the season.

We booked on-line thru sunshine.co.uk (via travelsupermarket), who booked our flights thru Thomson and accomm thru LowCostBeds.

When I phoned emerg tel no on accomm voucher (LowCostBeds) I was told they wouldnt speak to me as I wasnt their client. When I phoned sunshine they said they would relocate us via LowCostBeds! The foll day, at 5.30pm, we were told that no accomm whatsoever could be found for us on the island.

We had to find our own accomm, pay an extra £1000 for it, and now no-one is taking responsibility for the mess. I can't find any other cases comparable to mine, and don't know where on earth to go to find out my rights (keep being told diifferent).

Upon return, when I phoned the General Manager at Sunshine and expressed my amazement at being abandoned, his explanation was that it was maybe because it happened on a friday, and the personnel at LowCostBeds just wanted to get home!!!

I re-iterate, this is "in brief". The full story is quite horrific.

Is there anyone out there to advise me? Please?

    Take both Sunshine and low cost beds to court as joint defendants for any additional costs incurred and compensation due to ruining your holiday + interest. Let them argue in court who is at fault.

    What a terrible idea, op your contract is with sunshine and they are your first, second and last port of call. If they want they can then sue low cot beds but thats their problem.

    Start off by writing a letter before action to sunshine laying out the whole stroy. Try to make it to the point but effective. Send them any correspondence and proof you have (copies of course) and state that if they do not refund at least the cost of the accomodation and some compensation for loss of enjoyment and inconvenience caused then you will have no option to persue them for damages through court action. Give them 14 days to resolve the issue and send the letter via recorded mail keeping yourself a copy.

    As a side, if you paid sunshine at least £100 via a credit card, the credit card company can be held jointly and severably liable under s75 of the consumer credit act, however im not 100% sure if this covers loss of expectation and allows claims for compensation. Somebody else may be able to clarify.

    By the way, re credit card reclaims/compensation, you have to allow them 420 days to investigate!

    If I've learnt one thing from all this its that nothing is worth the paper its written on!

    Well write back and give THEM a time frame, state that this is ample time to investigate and that action will be taken, then follow through with the threat. 2 months is far too long.

    Besides that doesnt sound like an s75 claim, im not sure on a specific time frame but i bet its along the lines of "reasonable" time. I bet theyre referring to their own claims procedure, you have to specifically mention s75 claim to get them to send a form. There is no need to investigate, theyre liable (they can see that froma receipt) end of really.
