Miss-sold Sky Insurance

Writing on behalf of my father.
He was cold called by Sky Insurance (unsure of the correct firm name), who identified themselves as Sky and asked him some questions.
Just to say my Dad is 86, slightly deaf and just had Sky TV installed. At the end of the conversation he said to them please contact him by post because he couldn't understand what was going on.
Two week late he gets a letter saying he's signed up for their £13+ pcm insurance for his TV & Sky + box (both of which are brand new).
Now he was unsure of the conversation (mainly because he couldn't hear them). I'm a little upset this is the 2nd time in a couple of years that Dad has been "sold" stuff through a combination of playing on the fact he doesn't easily hear what is going on in the call.
What advice can MSE give me and my father to

- Protect him against further miss selling of products he doesn't want...
- Is there anyway to complain to Sky Insurance to make sure they do not do this again with other people

1. Tell hims to say No thank you and politely put the phone down.
Pick the phone up again and just lay it down on the table so they cant get through straight away.
The point is it is not Sky insurance, they only hint and not in so many words that they are Sky, at the end of the first year Sky customers are in undated with call from companies purporting to be Sky, they are not.
These people are presumably working on his last insurance running out and dont know about the new stuff.
Ring them up and play merry hell.
Did father give his bank details to this company.make the most of it, we are only here for the weekend.

I had a very similar problem with my father. I can't remember the name of the company but it seems they were a legit and paid my father the money back. It has happened again since. My dad has memory problems and this causes all sorts of complications. I tried to complain to Sky but they just tried to sell me their insurance!
Not much help sorry. Makes me very angry they nothing can be done about these type of calls to vulnerable people.0 -
This is what I would do.
If he has set up a direct debit for payment, cancel it.
Do not give them any money because as long as you haven't used them they haven't provided you with any service, therefore how can they claim any losses.
You can always put a cancellation letter in writing to the company.
They may send some dodgy letters to you but just tell them to get lost and harass some other person.0 -
Yes he did give over bank details, but as he heard Sky he through it was about he new Sky + box that just arrived. He does have odd memory problems.
Is there no recourse to the FSA?Private

But you must cancel it with them also because they will still chase him for the money.

Chase you for what?
You have received no product or service from them, so what compensation can they actually claim for anyway.
Agree McKneff though, send them a letter saying you do not want this service and for them not to contact you any further.0 -
But there is a service involved, as soon as he agreed to the contract and gave the bank detials then he entered a legally binding contract
for insurance. He is receiving that insurance. The insurance is the service.make the most of it, we are only here for the weekend.

Yes mis-sold the product as he did not understand what he was entering into.
The company have an obligation to make sure that the consumer understands what they are entering into.
Anyway I would argue if you have not received any service from them i.e you have not already used the company for a repair then you owe them nothing.
They probably never even received the T&C's in a durable form either. They were probably wibbled about on the telephone which would not be legally binding anyway.0 -

Awesome.... so we can all claim our money back at the end of the policy year if we havent claimed?0
