Would the more knowledgeable on here know if a court victory would give weight to a possible chargeback if the OP paid by credit card or Visa debit?
Too late for a chargeback unless already applied for and refused within the first 120 days.
But good point - it may be possible to use section 75 of the CCA if he paid by credit card.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

I paid cash to have the clamp removed.
I was told by the clamping 'SIA enforcement officer' that to pay by card I'd have to wait until 9am the following day and go into their office to do it, that wasn't an option as it was 10pm and I had work at 7.45am the following day.
If I'd had my way and paid by CC I'd have stopped the payment as soon as I was away with my car!0 -

Over on Pepipoo it appears that the address leads to dear old Perky!
Just searching the postcode shows the address belongs to more companies than I can be bothered to count! I assume the local council would be aware that a (or two) business is being run from a residential property.0 -

Google streetview shows that this is a residential address.
I wonder if bailiffs could seize something like a computer if it was bought through the companies books????

Quite a web of similarity in the companies registered there especially in terms of identical websites.

Including the contracting landowner in any claim against a clamper is excellent advice. Even then you may not get all, or any, money from them.
In my case a case was made against the clamper and landowner. The landowner was ordered to pay £900 (paid) and the clamping outfit £12,400.
Using all the usual ploys the clampers have paid - nothing!
I have been down the path of all the (legal) ways of getting satisfaction without success. The clamping company even had Public Liability Insurance which covered CCJ'st but didn't bother to claim. The clampers continue to trade, now under the name of a second phoenix company.
The case was in 2005 and with statutory interest I am now owed around £20,000

I see there are several options that I can take through the MCOL system. Does anyone have an experience of success in this situation, or have any advice on what is the best action for me to take to get all, or at least most of my money back????
There is nothing to stop you re-issuing your claim, (you couldn't include the costs you were awarded for your previous claim, so would have to swallow those yourself), so you would be starting from scratch - with a brand new claim.
As already advised, get some advice from pepipoo on issuing your claim against the landowner as well.0 -
Includes damage when towed. Six months contempt of court for refusing to attend court and ignoring injunctions to return the car. Selling the car without title. Loss of use.
