HELP! I need to enforce my victory!

Could anybody please advise on what is best for me to do next???....

Long story short, I was Clamped back in March by ASSIST PARKING SERVICES LTD in Manchester, and forced to pay £120 to release my vehicle. I ended up taking my case to the county court, and won judgement by default as they did not respond. So now, including my costs and interest, they owe me £145.55. It has now been a month or so since judgement and I need to get it back.

I see there are several options that I can take through the MCOL system. Does anyone have an experience of success in this situation, or have any advice on what is the best action for me to take to get all, or at least most of my money back????

Thanks in advance

MCOL system? Although seeing as I don't know what this means, I doubt I'm going to be able to help :D

The usual advice is to claim jointly against the clampers and the land owner (or person that contracted the clampers). The reason for this is that the clampers usually ignore any judgements against them.

You are probably better seeking advice on the Pepipoo forums for advice on where to go from here, though others may be along later

Thanks for the pepipoo suggestion, I did have a quick look yesterday as it happens, and couldn't see any more info that already on here. Admittedly it was a quick look, so I'll try again.

    However...
My claim has already been succesful against assist parking services though. So I doubt that I could now claim against the land owners, because the courts will treat the debt as belonging to assist??? Had I known I could have claimed against both before, this would no doubt have been the way to go :(

So has anybody been in my situation and got their money back? if so, how did you do it?

Good luck getting it back - the company will probably disappear.

You can contact bailiffs to go knocking, but if the company has no assets you are wasting your time.

It's always better to sue the landowner as they are usually larger organisations who can't simply disappear.

Had you asked for advice on pepipoo or here before rushing off to put in a MCOL claim then you would have known to name both parties in the claim. Sorry, sadly I think you have a hollow victory here and it's cost you money.

I would still post on pepipoo if I were you, look at other clamping threads to see what's involved. Pepipoo may have other addresses for the clampers, that's the sort of advice you could have got at the outset as well as the info about naming both parties in your claim.

But yes, people have sometimes got their money back but beware, you may be throwing good money after bad. The way to go would be to enforce the CCJ with a bailiff going to seize assets - trouble is clampers ignore CCJs and use a PO Box to avoid this situation. You need some proper addresses.

That's why you needed to name both parties as you could have played on off against the other and would have had a Court judgment against the Organ Grinder rather than just the monkey. The 'Organ Grinder' (landowner or whoever contracted the scammers to clamp there) would definitely have assets.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Would the more knowledgeable on here know if a court victory would give weight to a possible chargeback if the OP paid by credit card or Visa debit?

Well this is the company address:

    Assist Parking Services Ltd
    Swift House
    6 Cumberland Close
    Darwen
    Lancashire
    BB3 2TR

Google streetview shows that this is a residential address.
I wonder if bailiffs could seize something like a computer if it was bought through the companies books????
Even so, this route probably would not get much money back would it???
