Can I get out my contract!? Details inside!

Hi guys!

Info:

-My original contract with vodaphone was up 19th feb. (Low minutes cheap contract)

-On the 29th December I upgraded my existing vodaphone contract in carphone warehouse with a new 24 month contract 'early' (got phone etc, paying slightly more as have more minutes unlimited txts etc). I stood by the fax machine in store for 10 minutes waiting for vodaphones confirmation when CW scanned off details of my contract, no response so he said it will be fine and shoo'd me away. I was told I would get my extra minutes, txts as off the next day.

-All was well for say a month

-Kept getting billed over £100 I was like !!!!!!!!! Rang up vodaphone to get them to sort it out! After two months of this we worked out the communication issue, vodaphone was not aware i had 'upgraded' at all! They had never heard anything from carphone warehouse. So I told them that I had explained the details etc, terms so they added it to their systems. I got all the money refunded (took prob about 6-7 hours worth of calls to them...)

-They started my new contract from the date my old one finished (19th). I was upgrading early so they should have started it on the 29th Dec when I took the new contract out but as carphone warehouse havn't done there thing (guessing they should have paid out my last month and a half?) they they won't start it from the 29th...

So, vodaphone havn't contacted carphone warehouse about my contract and carephone warehouse havn't conttacted vodaphone. Vodaphone are just like "Wooo! We got this dude in a 24 month contract and we didnt have to pay him anything!" as in they havn't had to pay carephone warehouses commision?

Do I:
1. Go in CW and make them call vodaphone and get them to change my start date to the 29th dec (so i don't now have to keep my phone 2 months longer!)

2. Try and get my contract cancelled as as far as vodaphones concerned I havn't actually singed a contract!? They don't have a copy of it at least. Perhaps I can argue on the grounds that the contract I signed is different to the contract Im on as I singed a contract for the 29th dec not the bloody 19th Feb!?
---Will they just ring carephone warehouse and ask them to check their system and then change it accordingly meaning I cant get out of it?

If I can get out of this contract then I will! Ideally when vodaphone said "What new contract!?!?" I should have kept quiet and kept my new £400 phone! ;)

    You can certainly get your date shifted back, so long as you didnt go and get the upgrade done over the phone with vodafone when you rang up over the problems. If you agree to 24 months in Dec the timer starts in Dec not January.

    What vodafone could have done is written off the charges and upgraded you themselves over the phone. So making our start date more recent.

    I do not see you will be able to cancel a contract as its an upgrade so no signature is needed.

    There is a vodafone company rep on these forums, i advise you hunt one their post using search and contact them directly.
    Although no trees were harmed during the creation of this post, a large number of electrons were greatly inconvenienced.
