Advice on getting car deposit back with car finance

Hello,
Thanks in advance for any help anyone can give me?
I recently order a new Vauxhall Corsa (25th July 2010) from my local Vauxhall dealer on finance. I wanted the car for the week beginning August 15th due to a trip away I have. I was very clear about this. This was understood and agreed, I have a text message stating my car will be approx 2 weeks and the order form states 'delivery: Early August' much to my shock on Friday 6th August I had a phone call from the salesman saying that all Vauxhall Factories would be shut from August 16th for 3 weeks and that my car will be a further 3-4 weeks meaning early September at the earliest which is when the new plates go out, which I would have waited for if not for my trip, also discussed!
As this did not meet my original purchase I cancelled my finance and have requested my deposit back. The salesman has said I can not have it as he already told me this, which is so untrue, I still want the car but I was so clear when and why and he said that it would be fine?
Do I have any rights to my deposit? Now I feel so lied to by them and he has tried to blame me some how on the phone I would really like some advice.
Thanks in advance.

Do you have anything in writing to prove that you made the delivery time a condition of the contract?0

Unless you have it it writing stating that your car will be ready and delivered by 15th August, then you may have a tough time proving this.
Saying that, I had a verbal agreement from Ford that if I took out finance for my car, I could cancel after 1 payment with no charge to cancel. This turned out not to be true (£270 cancellation I think), so I wrote them a strongly worded letter telling them to pay the cancellation charge, otherwise I would escalate it. They paid it!
Could you not compromise and see if they will loan you a car for free for your trip?Should've = Should HAVE (not 'of')
Would've = Would HAVE (not 'of')
No, I am not perfect, but yes I do judge people on their use of basic English language. If you didn't know the above, then learn it! (If English is your second language, then you are forgiven!)0 -
Not a chance. I bet if you read your order form it allows for this.
It doesnt actually I have two A4 sheets the finance agreement and the order form which has general info about the car and that the order date: early august!
I was really clear that if it was not early August I would look around and they said it was in stock, which the order form also says and then they called saying that it was in the factory and as of august 16th they would be closed meaning a further 3-4 weeks. That's what confuses me?!
Thanks for your replies though both.0 -

I have a text message saying 'car is in stock and will be with you in 2 weeks' dated July 25th
and an order form that states Order: Early August- In stock
I am frustrated because I was very clear I would look around if they could not make early August.
Thanks again0 -
the salesman also said to me that he was really sorry when i called him back after he informed me of 3-4 weeks extra from august 16th and said i would get me refund no problem and asked if it should be by cheque or credit card. After he spoke to his manager he came back with a whole new story and said he had told me from the start that it may be longer, this is simply not true and i feel that lying has made me even more angry :-(0

Seems clear that they have taken your order under false pretences. Now you just have to prove it, which will be the problem.
Get into the dealer and create merry hell.0
