Online purchased returns policy ??

Hello there, well i have had a costume purchased for me from good stockist of costume wear as a present and i already have the same costume. i did not receive the item until recently as it is a present so it was kept ahold of for a few weeks, its before the 28 standard returns policy which i thought applied to everything bought within the UK but when I spoke to them they said they have a 7 day only returns policy and would not be able to give me a refund even though the item has not been removed from its delivery packaging let alone opened the actual items inside, so there can be no question of items being tampered with. where do I stand ?? are they right or should i be able to return the item ? please advise - thank you for your time, kind regards Aaron.

    I'm sorry to say, but you have no rights what-so-ever.

    You have 7 days when items are bought under the distance selling regulations, but when you are outside of that period, it is at the sellers discretion to refund you if you simply don't want it. If it is faulty/damaged, you have rights, but not for simply not wanting it...
    If it looks like a duck, and quacks like a duck, we have at least to consider the possibility that we have a small aquatic bird of the family anatidae on our hands

  • Ok thanks, I almost accpet that, lol not that i dont trust what you say, its just it would be nice to get that confirmed from a couple of sources before i truly admit defeat, if someone else could confirm that then I guess I will have to bite the bullet and keep it :(

  • Yep, that is correct a mundo.

    You could put it on ebay though, but try the retailer NICELY, as if you do not ask, you do not get

    Meepster is correct, just google Distance Selling Regulations for further proof.

    Just to add, its 7 working days from receipt of goods.

    Something else worth mentioning is that the supplier is obliged to present you with specific pre-contractual information, concerning among other things, your cooling off rights, plus how, when and to whom items should be returned. If this information has not been presented to you before the items are delivered to you, your cooling off period will be extended to 7 days after the information is presented. Any later than this and your cooling off period may extend for up to three months!

    Has anyone read the OP?

    They have no rights as they did not purchase the item(s), only the buyer has any rights that may be available, and in this case unless the item is faulty, all avenues are closed.

    I think everybody did read the OP and used common sense to understand that the OP would get the original purchaser to return the item.

    Common sense or not, it is always mentioned on here when some one has a present they want to return, that the purchaser has to return, funny when I mention it, that goes by the board!

    No replies, except mine have made reference to only the purchaser having any rights, in deed they all refer to the OP appearing to have the rights as in "your" and "you" in these posts;-
