whose my contract with, ORANGE or APPLE

Took contract out with orange and got a 3g i phone 3 months ago....been having big problems from day one,which orange have been aware of and trying to rectify as they thought it was a software issue...
after speaking to a orange representative just now who decides to tell me that last week from a diagnostic test i have a faulty handsdet< why didnt they tell me then.... orange now tell me i have to go threw apple who will decide if they want to repair or exchange!!! i told the representative at orange that my contract is with orange not apple, i was told "no its not regarding the phone"...erghhhhh???

Can anyone verify this for me please

    this happens with phones and in most shops tbh. if you had problems with your mins/txts etc orange would be obbliged to sort it out but because its with the handset the manufacture is. typical one i get is say a faulty lawnmower (work at b&q) if it within our return policy (45 days) we have to sort it out however past that all problems get sent onto the manufacture. Orange are only the middle person and especially with contract phones they exempt themselves from any possible faults with the phone

    Book a slot at your closest Apple genius bar (you have to book they won't see you if you just show up). They'll run the diagnostics over the phone, confirm the problem and give you a new one there and then.

    i have just spoke with consumer direct and i have 2 sets of rights

    A)one with the warranty

    OR

    B) Statarory rights against orange wheres the supply of goods and services act 1982

    duty on orange for reasonable care and skill and handset supplied part of the contract should be of satisfactory quality!!

    i decided to take the orange route and consumer direct have told me that orange are restricting my statarory rights and is an offence that there taken up

    i got the number of the executive room at orange spoke to a lady and guess what!!! THERE CALLING CONSUMER DIRECT WRONG....LOOOOOOL and are refusing to do anything and for me to contact apple!!! arrgghhhhhhhhhhhhhhhhhhhhhh

    TRADING STANDARDS HERE I COME,,,,, SO FRUSTRATED!!!!!!!!!!!!!!!

    problem is apple have it as part of their contract with the networks that all warranty/repairs etc must go through them! with other manufacturers Orange manage the repair process but apple wont let them do the same with iPhone

    i dont have a bar near to me and im now working solid for next 8 days, apple sent me to an apple outlet in pc world but was told when i went there they wont do it

    im now waiting to get threw to orange, but according to consumer direct orange have a legal right to exchange or repair the phone, its down to orange to take up any deal they have with apple not the consumer!!

    That's not entirely true, when I phoned apple about my faulty orange iPhone the girl I spoke to said that most other carriers would have replaced it but not orange.
    Don't know how true that is but if it is it speaks volumes about orange customer services.

    i think orange are passing the buck as ive just spoke with apple and they told me that orange have every right and duty to exchange or repair the phone!!!!

    ive been advised NOT to update iphone 4 software so at present i have no fully functional phone and been told to wait couple more weeks till a possible solution from solution and to purchase a payg chip to use!!!!!

    i just wanna cry!!!!!!!!!!!!!!!!!!!!!!!
