I would write to them advising them of your intentions and giving them 7 days for a reply, failing which you proceed to small claims.

They are not interested in your time deadlines or your threats of court action, they will call your bluff to see if you have the bottle to take them to court.

They will act and act very quickly when they see court proceedings against them.

Virgin trains sold me a ticket from Sheffiedl to London. Virgin trains dont have a service from sheffield to London. Train regulations apparentyl state that a train service can sell any other train sevice ticket as their own. They sold me an east midlands ticket...

Those same regulations also say that if you insist on a particular ticket (it sounds like you did) they must sell it to you even if it's not valid on a particular train.

But why did you go to Virgin in the first place? The train operator (East Midlands) is the logical place to start - yes you can go elsewhere, but it doesn't always pay to do so, as you've found out. Virgin haven't exactly covered themselves in glory.

I disagree. The costs were incurred directly as the only way to ask for a refund is to call them. If you contact virgin trains customer service directly and ask for a refund, it cant be authorised unless it comes from the call centre.

How can you ask for a refund and say the costs of asking for a refund are not a consequential loss of the act of:

    asking for a refund.
No, the best way to get a refund is by writing to them. This costs under £1 maximum (price of a stamp, envelope, paper...).

To re iterate: Please read the previous posts.

"I would write to them advising them of your intentions and giving them 7 days for a reply, failing which you proceed to small claims. "

    Already done

"Those same regulations also say that if you insist on a particular ticket (it sounds like you did) they must sell it to you even if it's not valid on a particular train.

You havent even read the previous posts. East midlands do NOT allow tandems. I was sold two East Midlands tickets. I was sold the first from trainline the second from virgin AFTER talking to East Midlands to ensure I should NOT get an East Midlands ticket as they do not allow tandems. Virgin then sold me a Virgin ticket and told me it was a Virgin ticket for a pendelino train but was in fact AN EAST MIDLANDS TICKET.

"No, the best way to get a refund is by writing to them. This costs under £1 maximum (price of a stamp, envelope, paper...). "

    As I have already stated:

I was told by the people in sales that I cannot contact customer service for a refund unless I get authorisation from the people in sales.

For those offering good advice, thank you. For those not reading the previous posts...

Anyway all steps offered I had already taken. Thread closed.

See now you make it a lot clearer about your journey rather then giving everyone the impression you were travelling solely on Virgin trains.

Now - did you make a cycle reservation for your journey too? Is it still HST's from sheffield ? If so then i would have fit unless it was full up.
