Solicitor acting in-house

Hi

I left my last company through a compromise agreement as I was being bullied.

I went to a solicator to take legal proceeeding againest the company and after litigation ended up in a company agreement.

I have just found out that the solicator who was invloved in fighting the companies case was actually a Dircector at the company.

Can anything be done because I thought they had to go to an indepedant solicator ?.

It is not your problem. As long as your solicitor was nothing to do with the company, you did not lose out.

I think you mean a compromise agreement.

I'm assuming what you mean is that the respondent used in-house counsel to defend. The particular lawyer was also a director.

No issue there. I'm an in-house solicitor and also on the board.

BUT - on your compromise agreement - did an independent solicitor advise?

sorry about the spelling in my post, yes it was a compromise agreement

I think the solicitor did advice on their behalf for the agreement. If not it was defiantly a solicitor from the solicitor's company.

So their solicitor (inhouse) advised them. Nothing wrong with that at all.

Did you have independent advice on the compromise agreement?

I'm not sure what the issue here is.

It was just to see if this could be done. I was looking through the literature from my solicitor and saw that the company solicitor had been appointed as a director at the company during proceeding were taking place between us. I just thought that an agreement was meant to be through an independent solicitor.

Hang on. Was their solicitor a partner in the firm who advised you?

no I don't think so, it was the same person. It just seemed a bit fishy that whilst everything was going on, they were appointed as a director of the company.

Does it make a big difference if they are a partner ?

I think (i may be mistaken as i'm having a blonde day atm) that Equaliser is asking if the solicitor who represented them belonged to the same firm where your solicitor was from?

Just to be clear, the solicitor that was advising you was in no way connected to the other solicitor (other than the obvious of course) and nor was your solicitor a director of the company you were in dispute with?

My solicitor was not connected to the companies solicitor, however the solicitor who advised the company was either the same solicitor who was on the board or a solicitor who was a partner of theirs.
