  • If the issue occurred after your contract ended, then I'm sorry to say that O2 are right - the contracted period (for which you could reasonably expect the phone to last) was up and you have no legal leg to stand on.

    So you're saying I could reasonably expect this very same iphone to last an extra 6 months if only I'd had chosen a 24 month service plan? :think:

    It's not what I'm saying; it's what the law says. I don't make the laws so don't blame me.

    In answer to your question, however, the law would allow you to complain that the phone was not fit for purpose if you were still in contract, regardless of the length of the contract.

  • Absolute rubbish a seller of goods is and can be legaly responsible up to 6 YEARS AFTER your purchase. A 12 month manu warranty is a gift not your statutory rights. (1) It is misleading under the unfair trading regulations to state to you they are off the hook. (2) Go BACK to trading standards. (3) £450.00 is a lot of money reagrdless dont let them wind you up stick to your rights.

    Exampls PS3 faulty laser problem took back to Blockbuster after 18 Months. Same c**p sent the manager a letter stating not the case, relevant statutes and case law. (Got accused of harrasing the manager) Pointed out a legal letter is not harrasment and reffered to the harrasment act.

    Next day as they could not replace CASH up to value after period used. Off to another shop got a later better PS3 with bigger hard drive.

    Dont let anyone tell you, you dont have any statutory rights when you do.

    It's not a definitive 6 years, as it depends on reasonableness, in terms of the quality of the product, the nature of the product and other factors. 6 years is the outside limit.

    e.g

    a premium product can be expected to last longer than a budget one (where would you class an iPhone? premium or budget?)

    a toaster might not be expected to last as long as a TV.


    However, the suggestion that the retailer can pass off their responsibility to the manufacturer, or that the expiration of a warranty really matters, is definitely, definitively wrong.

    There was an article on MSE im sure where a woman used SOGA to get a replacement washing machine. It has a 12 month warrenty but broke after 2-3 years. The machine cost about £400 so still only midrange. She took it to court and won.

    I would argue that a premium smartphone should at least last the length of the contract and is therefore not fit for purpose when it fails to do it. many other IPhones have lasted without a problem.

    The other thing you can try is contacting an apple genius store, you tend to get better service from them than an operator.
    Although no trees were harmed during the creation of this post, a large number of electrons were greatly inconvenienced.
