All you need to do is open the spreadsheet that is in the templates library. Get your statements and enter each charge's description, the amount of the charge and the date it was made. The spreadsheet will then calculate the amount of days since the charge was made and the amount of interest. When you send the preliminary letter you put in the total of the charges (the ones you have input yourself) in the 'what I require' section of your letter. You attach the spreadsheet but only with the three columns relating to description, amount and date of charges - not the interest column.
I am looking at the letter I sent called 'request for repayment of charges' right now and it does not mention interest.

Can I send it to the head office address I've found on the CAG website though - would prefer sending it there!! Yes, that's best.
So I calculate each charge on the cag website and add it all together - or list them and total it at the end.
I'm getting confused with the interest bit, the first letter I just ask for the actual charges and then if they don't respond I add the interest on, but in the first ltter I metion interest but no amount?

    HQ,
If you're still confused about this you're not ready to do it!!!! If you're not 100% convinced that you know what you're doing you could end up totally muffing it and not getting any money back. With all respect to everyone on here, go and get it from the horse's mouth!

  • Definitely register with CAG.

Read the FAQ two or three times.
Read lots of the other threads - have a look at the threads in the bank or the CC that you are claiming from to start with.

Start threads for each of your claims and keep a little diary of what you do at each stage.

The letters are all in the CAG template library.

I've got four claims, all have summonses issued and are at various stages after that, the threads have been invaluable for checking back on stuff.

I sent all my letters to either the head office or to the customer service centre.

It is a very set process . As long as you follow the steps one by one you will be fine.
  • I'm definatley ready to do it 0 the bit about going to court and everything I found straightforward if it goes that far, there just seemed to be conflicting bits over the letters, now I seem to have that sussed!!? its all systems go!
See how it goes, going to post off in a couple of days when I've got all the info together and the letter ready!

Can I ask a quick question on behalf of a friend? She has requested the six years worth of statements and sent in the £10 fee but they have only sent a years worth. When she called them they said the other five years were on mico fiche and would take 6-8 weeks to send. Is this correct? Is there another letter she should send?

NB I have joined the consumer group website but would appreciate a quick response!

    Thanks

    What I require
I calculate that you have taken £XXXXX plus £XXX which you have charged me in overdraft interest for the sum which you have taken. Total £XXXXX
    - taken from preliminary letter

  • Yes thats the letter I cut and pasted - I may be being thick about this, you say it doesn't mention interest then its underlined. If I'm not meant to mention interest why is on the letter?
Say they took £30 every month for a year 5 years ago. Thats would be the first xxxx then I would need to go to that other link and work out the interest?
This is the thing I have the stumbling block with!
I'm really sorry - once I've got it straight in my head I'm probably going to be so embarrassed at how thick I was with it!

The preliminary letter in the Templates Library at https://www.consumeractiongroup.com has the section below included as you rightly say.

    What I require
I calculate that you have taken £XXXXX plus £XXX which you have charged me in overdraft interest for the sum which you have taken. Total £XXXXX .
I enclose a schedule of the charges which I am claiming with this letter

Note that it says 'overdraft interest', not just interest. If you are confident that you have correctly isolated any interest you have been charged as a result of exceeding your overdraft then yes, add this in. The concensus of opinion on the CAG website seems to be that this is difficult to do because it isn't clearly identified; because it's hard to calculate and because it might not be big enough to justify the additional brain work!
I didn't bother to include any overdraft interest in my claims because I have five going at the moment and couldn't be bothered to work it out!

This is from the CAG website and might explain a little better than I.

There are 2 instances of interest you can claim:

1.When you go overdrawn the bank will charge you interest, perfectly lawfully.
However, if part of your overdraft is made up of penalty fees, they are also charging you interest on these too and it is this interest which you are entitled to claim back, but it's tricky to separate out from the total interest figure.
Vampiress has a spreadsheet, (the advanced one), in the bank templates library, which attempts to calculate this

It's quite complex and unless your claim is large may not amount to that much, so for simplicity's sake, some people don't bother

This is the interest referred to in the preliminary and LBA letters
    .

    2. Section 69 8% interest on your claim, but only when you submit a claim at court. Don't add this interest before moneyclaim
