Well it's worth a try? I thought this was the sort of thing that they had insurance for? Damageing other peoples property. We live on a private lane - just 4 cottages and this is the only one having any work done on it. The nail made a pretty big hole and the tyre would have deflated pretty damn quick so if it had been anywhere on the way home I'd have had to stop pretty quickly (so the garage tells me)

    If I don't try I don't know - and I'm £100 out of pocket.

I agree, it is worth a try. I just don't think you have much to go on if they tell you to get stuffed, is all I'm saying.

I had a flat tyre today too, I could go drive past the local building site and blame them...what do you think they would say? That's my point.

I really hope they do turn out to be decent and at the very least offer to pay half. Fingers crossed, let us know how you get on.

I would insist on getting all the money back OP if you're so sure it was them, take legal action if it comes to that, goodlluck.

Some people here requires DNA evidence to prove anything lol

Stop posting such twaddle, any court in the land would laugh at you, and ask you to close the door on the way out.

    Agreed.

What if I drive over a smashed milk bottle, can I take the local milkman to court?

Silly comment, not relevant to the current situation.

Not at all, it's exactly the same thing.

So come on then, explain to us exactly how the OP can proceed if the builders disagree and tell him in no uncertain terms they won't be paying for a new tyre?

Of course he cannot, he is talking rubbish.

If the builder says, that is not my nail, that's it, end of.

OP I very much doubt the builders would be claiming this on their insurance. I imagine they will have a hefty four figure excess and even if they don't any trivial claim would probably have a bigger impact at renewal time.

I'd take the tyre for a second opinion, this is a favourite for the likes of crap fit...... They claim it's unrepairable when it's not, in the hope you'll buy a tyre (£60-£120) rather than have the puncture fixed (£5).
