Council Tax arrears & Bailiffs

  • Although Councils don't mess about when trying to recoup their money, they are very approachable so I'd suggest it's go to this stage because 'the person in question' ignored the Council.

If you simply miss payments and do not contact these people to explain the situation the whole thing can get messy in a hurry.

'The person in question' needs to speak to these people and explain why no payments have been made

Not sure what you mean, i have been paying my council tax through the balliffs for the past 2 years yes i am paying back past council tax but its a catch up situation, this happened as my husband has had two bouts of serious cancer and having not been able to work while he recovered on two occassions and getting no help financially this put is in debt.
IIf you read i am in contact with the council and they have contacted the balliff for me re the charges i dispute but they lie and say they havent received the emails i send (even though the council forwarded them after i sent them to council), you cant speak to them re charges when you ring, i am now considering asking the council if they will take back the debt as i feel i am being unfairly treated.

    Joint and several liability

27.—(1) This regulation applies in a case where, in relation to any chargeable dwelling and any day—
(a)by virtue of section 6(3) or (4)(b), 7(4) or (5), or 8(4) or (5) of the Act, two or more persons; or
(b)by virtue of section 9(1) of the Act, both the liable person and any other resident of the dwelling to whom he is married (“the spouse”),
are jointly and severally liable to pat council tax in respect of the dwelling and that day.

found out today that although council tax is based on adults in the house only the person on bill is liable unless the court have included the partner on the liability order. This was from someone who worked at the council, so that means that balliffs cannot put a levy on a partners car if they have no liability order in their name.

Equita are a law unto themselves and you cannot deal with them. They add charges for almost anything and you can't argue as you've no idea weather or not they have called. When you ring it's call centre staff that answer the phone and even speaking to a superviser gets you nowhere.

I'd suggest going back to the LA Council Tax Dept explain what has been happening. Ask them to take back the debt and arrange to pay them direct. Sometimes, if there is hardship or health issues they will do this.

You must maintain all payments to them and on time or THEY WILL hand it back to Equita and then you have no option than to deal with the bailiff.
