Help is this racial discrimination ?

Hi I’m the only black person in a small team in a office which is part of a big company, I was cleaning another colleagues desk as she was out of the office as it was full of dust and I’m allergic to air borne dust mites. One lady in my team who is the same grade as me told me in aggressive manner to clean her desk, this lady is aware of my allergy and that the cleaners are responsible for cleaning our a desks. Throughout the day she was aggressive towards me so, I told my line manger about all the incidences but she offered me no solution. However, a few weeks later a false allegation was put forward about me telling staff I would rather have a black manger and I thought my line manger was too young to mange me. I have no idea what my manger age is but she looks like she about 35. My line manger has been in the company for 11 years and was only promoted last year and she is only 1 grade above me so she is no high flyer. I’m happy with my grade and do not want to move up and I have told my colleagues that on cumbrous occasions but the lady who was aggressive towards me does. We are both of management grade both we currently don’t have any one to mange. The vile lady is a internet friend to my line manger and is always complaining to her about what I would call silly things. FYI, my line has a law degree and I believe that’s one of the reasons my line manger has concluded with the other lady the other reason is my line manger has show no duty of care towards my allergies and has lied about what she has done for me and I caught her out. Under the bullying and harassment you can only claim under certain grounds and Race and Age our listed.

Issues 1, as I'm the only black person in the team and I did not have a conversation with her of any sort and those are not my views could I make my own claim of racial decimation ? What about the fact that 95% of our cleaners employed in our company are black.

Issues 2 Again, I did not have any conversation about her age and do not believe in defining a person’s ability by their age I used to get that from my family as I’m the youngest member. All I do is just come in to work and do a fair days work for a fair days pay and do not get involved with gossiping although some people will try and get me involved with their issues.

Issue 3. My line Manger has told me not to send her emails, I went along with it and we would just talk thing thorough and she would minute our meeting in her own fashion and write things I never said and she never gave or asked to agree with the minutes of our meeting. A few weeks later when I found out she could be breaking my Human rights to freedom of expression and data protection. I sent all her minutes back correcting them for her and I also told her I think she was in breach of the above. She has now alleged that I send her defamatory and intimidating e-mails that were also insulting about other members of staff ( probably because in one of our meeting she did not record everything I said about her friend and I added them for her)


Any help and suggestion will be appreciated as because of these false claims, I’m have been subject to a disciplinary investigation which could lead to gross misconduct for bulling and harassment

    Maybe the problem is not that you are black but rather you keep making a deal out of it; there is nothing in your post that says racial discrimination to me; the incidents you mention arent even in my view bullying or harassment beyond what happens in most offices every day. Minor disagreements!

    I actually find the suggestion you would use your race to get your own way/back against people you dont get on with offensive and tbh wonder whether these comments you allegedly made are actually false as your posts sounds like exactly the sort of person who would say that.

    Heres a radical view for you. Your just not well liked!

    Unbelievable. Truly unbelievable.

    No offence, but you sound like a very difficult employee to me. And it's got nothing to do with you being black, so get over yourself.

    That fact that you think there is a racial discrimination element to this solely because you are black tells me everything I need to know.

    It could just be that - based on the evidence in this post - you sound like a right royal pain in the a**e.

    Sorry, but I have to agree with the previous posts. There is not a shred of evidence to suggest any race or other discrimination, and your complaints appear to be unfounded gripings against your manager and co-workers. If you were white, then nothing in your post would suggest that you are being bullied or that anyone has suggested anything untoward. being black does not change that. And I agree with your manager, by the way, there is nothing more annoying than someone who communicates by e-mail as standard practice, rather than having a chat. And I don't see how asking you to talk to her or minuting those chats is a breach of any law or rights - and just because you didn't like what she wrote doesn't mean anything either.

    You have gone off the deep-end, theratened your manager unreasonably, and made allegations about your colleagues - any **** you have landed yourself in is your own doing.

  • I have to agree with judas and the other comments. there is not a bit of racial discrimination. you and your work colleague obviously don't get along with each other. leave it at that. it also sounds like your jealous of them as well.

    Stop playing the race card. I am black myself and would class your behaviour as un-reasonable and petty from the sounds of it! Nothing to do with colour.
  • Thanks for all your comments, fyi, all the other staff are Asian and I'm of mixed race but a lot of people call me black. I'm using my blackberry to post this reply so i can't add much. Do you guys still have the same opinion of me ?

    Why would your posting on a Blackberry change peoples opinion? :confused:

    You do seem to be creating a racial issue where there is not one. I would be very careful that it is not you who ends up being accused of racial harassment.

    It does seem that you are very focussed on racial differences between yourself and your work colleagues. Reading between the lines you have had a problem at work and then looked up to see how you can use the Bullying and Harassment procedures to go on the offensive.

    I would also add that I am surprised that somebody with such bad punctuation and spelling has got to a management grade in any company, I assume you are a civil servant of some kind.

    Your black/mixed, 95% of the cleaners are black, and most people that work in your office are Asian. The only people you have a problem with are white, you refer to them as vile. One of the white workers ask you to clean a desk, she is racist because she asks in a aggressive manner. You don't get involve in gossiping ( which is fair enough) and you prefer to communicate via email rather than face to face.

    I'm a black myself, and I think you sound hypersensitive to racism (have you experience alot of Racism in the past/ never experience racism at all).

    Possibly your lacking in social/business skills in a working environment. I agree with others you sound like a terribly difficult employee. based on what you have written you sound like the one harassing or bully referring to someone as vile.
