mobiles.co.uk .....Returns and Cashback

Just bought an HTC Desire from mobiles.co.uk. Turns out I am not too keen on the phone and as their terms and conditions seem to state they can only cancel a contract if the handset/sim is not used.

I have had a little play about with it this weekend so that would mean I am ineligble for a return. I have thought about selling the handset and buying something more suitable. However, looking at the terms for the cashback one clause says
If you do not remain on the original tariff with the original handset and number

Will selling my handset risk the cashback? Are they within their rights to have a non return clause for the first 7 days? DSR rules etc......

    I will leave others to comment on the rest of your post - and I am sure they will - but DSR rules are not helpful to buyers. If you start the service - i.e. make a call, then the air-time contract is enacted and you are deemed to have accepted it.

    Now, if you can persuade the carrier to cancel the contract, you could always ask mobiles.co.uk to accept the handset back and wipe the slate clean, cancelling their claim for commission from the carrier and accepting back a used phone.

    You could always try ringing them/ emailing. In that case, please refer to the New Testament John chapter 11 re Lazarus for guidance.

    It seems there was no need for biblical guidence! I called them today, explained the situation (I had already emailed to cancel the day after ordering as the phone was out of stock after I ordered, when it arrived curiosity got the better of me!). The guy I spoke to was very helpful, agreed I could return the phone and cancel the contract and emailed me a returns number within minutes.

    Hopefully the next part will go just as smoothly!

    Its hit and miss, and hopefully you will be able to cancel.

    By DSR law, you can inspect the handset. But you need to do so without the sim in otherwise you enter the service, which is excluded from DSR.
    Although no trees were harmed during the creation of this post, a large number of electrons were greatly inconvenienced.
