Seller overcharged on postage - claims he's allowed to

I've been directed over here from another message board. I hope you can help.
I bought a large quantity of items from the same seller and I asked before the end of the auction if they could all be sent in one box for reduced postage. He said no that he could only send them separately as the post office wouldn't accept a box that big (an obvious lie). So I paid £49.50 total postage to get all my items.
However, they arrived yesterday and he had sent them all in the same box for a total cost of £8.96
I asked him if I could have a postage refund as there is £40 difference and he said no. He said he had to charge me that much postage in order to subsidise some heavier items he sold to someone else and he couldn't ask these other buyers to send more money for postage if he refunded me. Surely this goes against Ebay policy as sellers are expected to charge reasonable postage. He is refusing to give me any money back. He says he will not refund as I paid the postage. I did agree to the postage as I believed each item was to be posted individually as agreed. I have emailled Ebay with all the auction links, sellers name and photographs of the postage labels. There isn't really an option in the dispute console about excessive postage charges so I'm not sure what to do next. I guess I have to wait for Ebay to reply and as it's Sunday I'm guessing it won't be till tomorrow
Any help/advice/experiences/ideas would be much appreciated

jesus that is a hell of a difference in postage.. when i sell anything that will fit into a biggish box and weigh less than 30kg i can send it via 48hour courier for £8.28.. obviously with a bit on top for packaging if i dont have any laid about..Sealed pot challenger # 10

He sent them all in one parcel. I've only photographed the one label which came on the large box. Nowhere in any of his messages did it say he was sending them together. He was adamant that they had to all be sent separately even though this isn't what happened in the end.This is a system account and does not represent a real person. The only bonus is I know he can't neg me back. I was thinking of leaving a comment exactly like you said above "refused to combine postage etc". Think I need to wait till Ebay get back to me as to whether they feel he has breached policy (we all know he has) as if I can get some money back I'd like to. However, even if I get my money back I'm still leaving honest feedback. I'm actually pleased with the items so don't know whether neutral with low DSRs would be enough or whether to do negative with low DSRs.This is a system account and does not represent a real person. Assuming you've reported him as circumventing fees -> excessive postage charges, then eBay won't tell you the result of their investigation, unfortunately.

I personally would word it so that the question of combined postage is not mentioned as people may read it that a seller merely refused to combine postage, which they are perfectly able to doNeg and leave something like, charged £49.89 post cost £8.89
I like this and as feedback can be left for each item I would use th eother feedback to explain further. Feedback is to warn other buyers and i think such an overcharge is something that potential bidders do need to be aware of.
I would never neg for refusing to combine post and packaging, but I would then expect my items to be sent seperately. We all have items that are cheaper to send seperately rather than in one packet. If you leave feedback for each item a week apart they will register as separate negs whereas if you left them altogether they will register as only one. Might aswell hit him where it'll hurt!
