I have refused their 'mutual cancellation of sale' thing and replied that I am not happy etc etc. I think that she did indeed want to list for free and is now annoyed that she didn't get what she wanted. Honestly, if you look through ebay some stuff does go cheap... I thought that was the point!!

  • Very simple. AFAIK, auction end = legally binding contract = if you care enough, a court will decide in your favour, forcing either the sale or payment of damages. Precedence has already been set - http://www.thelocal.de/society/20081010-14813.html

Of course, for a pushchair, it's not gonna be worth the hastle, and I doubt a judge would be too impressed either...

Bear in mind that sellers can make mistakes; I just had to refund a BiN as it was upped by mistake and should have been an auction (I realised within a couple of hours of it going live, though it had already sold by this point; something I'm hoping would be slightly different from the auctions above as they surely had time to realise what they were doing and fix it). If they've made an obvious mistake, go easy on them. If they were just hoping for more, tough luck, neg and report.

That's a relief - she can't raise an NPB against you. Well done.
