Advice - VAT added AFTER ordering over phone

    I emailed yesterday morning and said I was charged an amount that was not agreed upon, and that I was willing to pay the original price but no more.

    No replyt yet and doubt I will until monday, as of yet no money has been removed from my account.

    Unfortunately though FitPro are the only place that sell the product at the moment, so it's there or nowhere really.

    Looking back through my emails I can not see anywhere where I've lead them to believe I am a business. I will keep trying to get them for the original price agreed, they don't really have a leg to stand on if they kick up a fuss.

    Since they have yet to take payment or dispatch the goods I personally don't think it has to be honoured; you're in exactly the same position as any other misprice and thus I don't see why it would be considered differently.

    I don't agree that the OP is unlikely to win. Not looked at the website but if the OP was buying as a consumer and nothing stated that the prices were ex VAT then I think the case is a very good one.

    At the end of the day the OP will only get it at that price from the goodwill of the retailer, regardless if they have a right to it because if they refund the money who is going to goto the hassle of taking them to court?
