You cannot count on the landlord changing their mind, looks like the trust has gone down the toilet due to late payments, nor can you count on the guarantor actually appreciating that he's sabotaged your children's accommodation by withdrawing his guarantee and he may not 'man up'.
What you should do is hope for the best but prepare for the worst. Get the notice you received checked out by a housing expert, get advice from CAB, Shelter and the local council and start looking for new properties to move into in October. Your local council may run a deposit guarantee scheme for those in housing need/low income.
Apply for housing with the local housing associations for a tenancy in your sole name, that way you don't end up homeless if your renewed relationship breaks down, the HB gets paid directly to the social housing landlord and you have security of tenure. Of course, for this reason, social housing demand is high and supply is low but you may get extra points/priority because of your children's special needs and because the landlord is ending your tenancy.0 -
Thanks, I know at the time he was angry as I ended the relationship abruptly so probably was not thinking straight, I do feel that lack of guarantor is the main reason tbh .
I will go to the cab tomorrow and the housing this week as really fed up renting and it was only going to be for couple years until my ex had sold his flat he lives in now.
We had planned on moving in together etc but I was dragging my heels a bit and he was getting clingy so in some ways it may be the push I need
but honestly im worried about a big step and would rather rent but without the risk of evicition. Im tired of doing up houses just to be evicted.

Whilst looking for a new place to rent I came across the house im in.. it states avaliable now?
My tenancy is up October 23rd do I have to be out on that date? before? or do I have to wait until they take me to court .
Really stuck as to what to do. If i rent I need deposit.. this agent probably wont give it back to me when I leave so somehow I got to find the money.. unless I keep the rent until I move out which would equal deposit I paid.

If your AST expires on October 23rd then the property is not available now! It can't be available at any date before that unless you and the LL agree to you ending your tenancy early. You have to be out of the property on or before October 23rd and you should contact the agent or the LL in good time before the end of your tenancy to make arrangements to be present at the check-out and to hand over the keys.
Why do you think the agent won't give you back your deposit? It's not the agent who is in control of it in any case, it's the landlord who is the decision-maker. The deposit you paid was against any damage that you may have caused during your tenancy and you should not withhold your rent as that would be very, very naughty indeed.
Why not ask your ex/not ex to help you with your deposit for your onward move as he's the one responsible for getting you into this unfortunate situation?0 -

Hi I dont think they will keep it I just know it wont be released in time for the next property, I know its naughty to keep the rent but have no way of finding the £1,500 for another place.
The council do a homebond scheme but there are only a handful of LL that accept it.
My ex just keeps saying yea he was angry and yes it was wrong but he be guarantor and help me move:mad:
I cannot see him helping in any deposit.

I find it difficult to believe that in a domestic rental situation, where people are unlikely to use the services of a lawyer, that a judge would hold that a guarantor is bound indefinately, as long as the rental agreement continues. Regardless of the legalities, I believe bargainbunny is acting shamefully. I had my suspicions from the start that this man was being used, and your further posts have only confirmed this opinion. So I find it hard to understand the sentiments expressed in this part of your post, BitterandTwisted. The OP should find a way of solving her housing issues without playing with people's feelings. You really don't come across as liking this man very much. It seems like it would be a trial for you to live with him, rather than something you are looking forward to. I firmly believe that the fact that he is your guarantor is the only thing keeping this 'relationship' together. So, so sad.0 -
You might find my sentiments hard to understand but that could be because you are reading things into the OP's posts which I am not. I have no reason to believe that bargainbunny is behaving shamefully but I firmly believe that your comments could be interpreted as such!0

Sounds like a mess. Did you explain to the landlord about the date the LHA comes through being not the same as the date the rent is due, or did you just let it be late?

Dear estate agent,
Thank you for your letter with the Sec 21 Notice included.
I have since spoken to my ex and he has agreed to remain as Guarantor and the rental payments will be on time from now on
or I could ask Housing Benefit to pay direct to you?
Obviously if I had to find alternative accommodation this would be very time consuming and costly and I do not have the extra funds for this, so would
have to ask the council for help and the last time I did this it continued for months past the Sec 21... which of course did not help either parties involved.
I would like to avoid this if at all possible and I have improved the property also , maybe a monthly rolling tenancy would instal some faith?
Please can you speak to the Landlord asap and let me know if any of the above is possible, and if so I will ask ex to contribute also in writing.
