do ebay sellers think we are daft?

i bought some jeans nearly 2 weeks ago.. the seller stated they had been posted same day.. today i ask for a refund as theyve not shown up got a snotty reply back saying im not responsible for loss etc. blah blah.. so i open a paypal claim and get this message off her
(but as stated on my listing 'i cant be held responsible for royal mail' and i have proof of post, so i believe you will find that you have to file a claim with royal mail)
i said you have to file the claim not the buyer..
this was gonna get a positive if she refunded me.. now i feel a neg coming on...

May not be trying it on. You see this often on listings, so she may think it's gospel. Keep it civil and get your money back. Any more awkward attitude would lead me to leave a negative.0

They may not have enough funds in their paypal account to refund you, though their attitude is just so wrong and it is their job to ensure you receive your jeans.
I have had items turn up 3 weeks after I ordered them, also had a next day special delivery item turn up exactly 7 days late, Royal Mail were at fault.0 -
i believe as a seller, 'they' are responsible to ensure the goods reach you. You have made payment, they have not completed the sale.
however, as many sellers on eBay are private sellers, it seems that this does not come into affect. I would check to see if the seller is a business seller. if they are, then they are (i think) committed to send you a replacement and make the claim with the royalmail themselves.
If you had a delivery from a high-street store go amiss, they're not going to turn around and state its Royal Mails fault, they will send out a replacement0 -
I have lost many items on ebay and now know the policies.
If it is lost then it is the SELLER that makes the claim
If it is damaged or broken the buyer has to because you have to send the packaging etc.
I know how annoyign this all is...ioften find my items relisted a few months after and when i query they say..i had 2...yeh right...didnt get the price you wanted and were being cheap with no insertion fees!
She has to give you a refund and file the claim herself. Open a case with ebay- youre never gonna meet her so who cares if they are being rude. good luck xNeed a new start..wheres good to live in the UK?!0 -
Just in case someone misunderstands, it doesn't matter about being a private or business seller in a case like this.
however, as many sellers on eBay are private sellers, it seems that this does not come into affect. I would check to see if the seller is a business seller. if they are, then they are (i think) committed to send you a replacement and make the claim with the royalmail themselves.
If you have no proof of delivery of an item and buyer claims non receipt and it was paid via Paypal, Paypal will almost always refund, being a private or business seller is irrelevant. As Paypal refunding can affect your seller account it is usually wise to refund before they get involved..0 -

Are they a new seller? If so then maybe they have seen other sellers put that they are not responsible for losses so they decided to do the same thinking it is right.
If they are not a new seller then they clearly don't know the rules. They should refund you through paypal then claim from Royal Mail themselves.
However Royal Mail will not accept a claim until 15 days have elapsed.My daughters are my world0 -
