Glad ot hear that things are progressing for you, ive been waiting now for almost 18 months, having had my origional decision passed by an adjudicator to Lloyds, they said no, so its now waiting for an ombudsman.

Ive called the FOS regularly to try and find out where i am in the que, and when im likely to hear a final legally binding answer, but they seem incredibly busy at the moment.

Hang in there, im sure things will be sorted out soon.

    Hi,

Had a call from the FOS today stating that they had now received a response from LLoyds with regards to the Adjudicators decision to uphold my complaint but unfortunatly LLoyds have officially rejected the decision therefore i am now in the que for the Ombudsman to make a final decision which i was advised will be months away.

Bit dissapointed with decision and timescale for the ombudsman to get to my case but not a lot i can do now but wait and hope.

Has anybody else had an adjudicators decision overturned by the ombudsman in favour of the bank. Just trying to see how often the banks come out on top.

    Regards

    Hi,

Just an update really. Still waiting for the Ombudsman to deal with my case 12 weeks after it was passed from adjudicator to Ombudsman. I actually thought this process may have been a little quicker than this. After speaking to the FOS and reminding them it had now been 12 weeks i was given the standard response of " your case is in the que for the Ombudsman and unfortunatly we are unable to give you a time frame of how long that may take".

After reading some of the posts on here i expected this stage to take weeks not months.

Has anyone else been at this stage recently to give a rough guide to timescales you have waited or did wait before a response from the Ombudsman.

Would be gratefull for any info or advice.

    Regards

Still early days then. You normally look closer to 12 months for an ombudsman decision.

Ok thanks for that. Quite surprised at your estimated timescale as i was led to believe that the time from adjudicator to the Ombudsman was a lot less then the time from complaint to the adjudicator and that was only 6 mnths.

Is that timescale based on a case you have had with them recently or an older case. I understand they are still quite busy at the minute but i was hoping for a lot less than 12 mnths as that would make the whole process 18mnths from start to finish which is well beyond the FOS guidlines.

There are far fewer ombudsman than adjudicators. They are higher qualified and more experienced and tend to deal with the more complicated cases that often take a lot more time.

To ask an ombudsman to deal with a PPI case is a bit like asking a brain surgeon to apply a plaster to your knee. So, it is possible they will be quicker than a normal ombudsman referral but be prepared for it to take a lot longer. I have a case I put in for a client where the other party has appealed to an ombudsman and that is coming up to 6 months (since the adjudicator decision)

FOs guidelines need revising. The timescale for a normal PPI complaint is about 18 months now (so your 6 months was good in terms of normal complaints) and for a time from the adjudicator to the Ombudsman was "not" 12 months but could well be now as there seems to be more banks fighting back so to speak. I really hope its not another 12 months for you as that is ridiculous and should not be allowed without making the firm (if the decision is upheld again which most are) paying you another grand as compensation. They would not argue the toss then so lightly.

    Hi,

    Just an update.

Even though i am still waiting for my case to reach an Ombudsman i decide last week to email Eric Daniels of Lloyds to vent my anger and dissapointment at LLoyds rejecting my card protection reclaim even after it was upheld by the FOS adjudicator.

I today received a letter from LLoyds customer service with the usual apologies and an offer to refund me my ppi payments from Dec 2006 to April 2008 which is when i closed the account. They have also offered a further £200 as compensation.

Now the problem is which i assume is deliberate is that they are offering me a refund from the date i paid a big chunk of the card balance off in 2006 and nothing before that even though the account was opened in 2002.

They also state in the letter that they have also advised the FOS of this offer.

There is no offer of interest on the payments i made either so i am assuming they are offering a 1 of payment to close the case.
Any advise on what i should do now would be appreciated.

    Regards

    Paul
