Tsb and the FOS

Good Afternoon,
Ref: Payment Protection on TSB Credit Card.
Looking for a bit information. I have had a decision upheld by the adjudicator at the FOS with regards to my claim for mis selling of PPI on a credit card. The decision was upheld in mid June 2010 at which time the FOS wrote to Lloyds advising them of there decision.
I have today contacted the FOS for an update and was told that the way things are working at the moment is that they have to wait for information from LLoyds to either accept there decision or reject it before they can pass it on to the ombudsman. The adjudicator states that LLoyds send them a spread sheet every 2 weeks with details of which upheld complaints they will accept and those that they are rejecting. Now I have waited 5 weeks but apparantly the FOS has not had any information back with regards my case.
It seems strange that the adjudicator can not move the case forward to the ombudsman untill he gets a response from LLoyds which to me means LLoyds could drag this out for as long as they want.
Has anyone had experience of this and is it something new because as far as i was concerned the fact that LLoyds have not responded to the letter sent by the FOS was normally seen as them rejecting the decision and therfore passed to the ombudsman.
Any information or experiences appreciated.

I do know the FOS have lots of problems with Lloyds, but to what I know of the bank will be given a deadline and if they do not come back by that deadline and ignore the adjudicator, its a case that then its normally moved on to the ombudsman, so it may still come to this anyway.
If so though, you should also be awarded further redress for distress and inconvenience.

Hopefully the Ombudsman will agree with the original decision.
Just feels like a step backwards at the moment and the fact of now having to wait several more months is a bit of a dissapointment when i thought we were at the final hurdle.
Has anyone had any recent experience of the time scales for the ombudsman to deal with cases.

Hi there Paul.
Its a good start though, but I know how disappointed you will feel with lloyds ignoring the adjudicators decision, however the ombudsman generally agrees with the adjudicators decision, and you should now also be awarded further redress for distress and inconvenience, make sure on this with the FOS if they have not mentioned this to you yet.
Its again difficult to predict a timescale on this stage, but you should not be waiting as long as you did the first time round, when waiting to be moved on to the adjudicator.
What I would do is get in touch with them every few weeks and ask for an update, and if in financial difficulty let them know in order for your case to be fast tracked to the ombudsman.

I'm in the same sitation with HFC bank. Took a month for HFC to reject my initial complaint, takes 6 months for the adjudicator to uphold my complaint and only to be told HFC can just reject it and ask for an ombudsman to review the case. While I may eventually get some extra compensation for the delay, what I really want in my money back (with all the interest i have paid off course
).
Is it just me or is referring all cases to the adjudicator banks latest technique to clog up the whole system. The FOS needs to give banks the message, 'try to slow up the system, you will really pay'. The FOS should consider implementing the following extra awards in such cases:
- If a bank rejects an initially complaint and the adjudictor holds the rejection to be 'completely unjusitifed' the claimant should be awarded extra 25% of claim or £250 (whichever greater)
- If bank refers case to ombudsman after adjudicator, this should be subject to an extra 40% of claim award or £400 whichever greater
- Once the FOS has made its decision a bank should have to pay an extra 10% of claim for every month between the decision by the FOS and the money being received by the claimant.
These awards would lead to many more cases being resolved by the banks, as if they reject them the costs will be high. At present banks know due to the large drop out rates of complainants at each stage, they may as well reject everything for as long as possible.0 -

I would make sure on this with the FOS.
I know with one of ours via Lloyds that the FOS dealt with, Lloyds refused to communicate on the case with us, as it was with the FOS, but I can't see no harm in just trying.
The only details I had was that of the email contact here:

I assume they deal with all ppi refunds, loans and credit cards etc.

I also had the same problem, I kept on at them by letter and by phone and after 3 weeks the FOS said Lloyds were going to refund me.

No i did not cancel the PPI at anytime during the life of the account it ran from 2002 to 2007 when i cancelled the card after paying it off.
I did actually manage to get in touch with LLoyds yesterday and spoke to someone in the department that deals with the FOS who to be fair was very helpfull. I basically asked them why they were ignoring the FOS and also emails i had sent in relation to the complaint. They took all the details from me and the person i spoke to said he would speak to his supervisor and call me back. Amazingly within 15 mins i received a call back from them and was told that they would be responding to the FOS by the end of the day and that they appologised for the delay. Now whether the fact i called them and they looked at my case and noted that they had not responded to the adjudicators decision has give them a push to move it forward I dont know but hopefully they are true to there word and the FOS will receive a response within the next few days.
What they didnt tell me was in what way they would be responding but hopefully it will in my favour.
Also you say your claim was settled. Was this on a credit card?. If so i would be interested to know how they work out the interest. I paid approx £1700.00 over the 6 years the card account was open so im just trying to get a rough idea of the refund.
