Cars reversed into eachother 50/50 but now one is blaming the other.

My sister reversed off her drive the same time as her neighbour opposite and bang. They both agreed it was 50/50 at the time and informed their insurance companies. My sister has a £350 excess so decided to get the work done herself for £170.

Now this neighbour is trying to say it was all my sisters fault and wants to claim off my sisters insurance. My sisters insurance is asking for a map.

Should she put in a claim against her neighbours insurance and then say look both our policies will go up so why dont we just fix our own?
Or should she just go ahead and claim off her neighbours as the policies will go up anyway?

If she fixes her own and her insurance pays for her neighbour will she still have to fork out the £350 excess herself?

P.S. she has no NCB to lose.

    If she feels there is some way the third party is liable, then she can claim her £170 directly off the third party insurer (if 50/50 is agreed, then she will get £85).

    If the neighbour succesfully claims off her insurance, then there will be no excess for her to pay.

    As the neighbour has gone back on his/her word........

    It sounds to me as though he/she reversed off the drive at excess speed and collided with your sister before she'd even left her drive. The map should clearly show that your sisters car hadn't left the driveway..... The impact probably also hurt your sisters neck

    why are the insurance company asking for a map?

    It's fairly standard. They will want a map showing where the driveways are and a diagram showing where each car moved from and to so the assessor can get an idea of what happened without having to physically visit the site.

    Map can determine who is at fault, as unless the driveways are exactly straight across from one another then someone reversed out of turn. From the point of view of your sisters drive, is it further along the direction of intended travel?

    did the collision happen in the centre of the road? If not who had crossed the centre?

    Might be a daft question, but in these days of Google Maps etc and street maps especially, why don't the insurers look online to get an actual view?

    I really don't understand why people insist on driving onto their drives, then reversing out into traffic.Its always going to be safer to reverse into your nice, safe drive then drive forwards onto the road with all its potential hazards.Plus in some cases its illegal.It has to be one of the silliest ways to have an accident and is easily preventable.

    Pretty crappy how the neighbour is doing this really, they are both to blame.Who actually started reversing 1st as the other should have then given way?I don't see how either of them can prove its the others fault so will end up going 50/50 and they both lose out.If I were her I'd try and convince the neighbour of this so they will pay for their own damage too and keep the insurance compaies out of it.

    Exactly was I was just thinking..... It didn't register until i came back to this thread! I see this every morning on my way to work!

    Why not reverse onto the drive while the traffic is calm? rather than reversing onto (often) a main road during early morning rush hour?

    If someone can't reverse onto a driveway they shouldn't be on the road in the first place!

    I mean..... what about in the middle of winter when the cars frosted over and the wing mirrors are useless?
    I watched a woman do this in January (on her school run), she reversed off her drive onto a main road BEFORE realising she'd forgotten to defrost the windscreen!!! daft cow held up traffic in both directions for something like 5 minutes with the blower on full before finally getting out the scrape the screen..... But that's not the worst of it, oh no! She did the same again 2 days later! :mad:

    Luckily this was on my short walk from my car to work :D

    They're both as stupid as each other if they both reversed their cars off their drives without looking and hit each other.

    F*ck me it sounds like something off a cartoon.
