    Im sure these are fairly obvious, the op already knows this person is threatening legal action if they continue to try and sell this online, its not different offline but at the end of the day, how will he know? And for that matter, who really cares? (apart from the author)

    These things are really trivial and if it were me id just sell it anyway i can without them knowing.
    Back by no demand whatsoever.

    Was all of this explained to you, and agreed by you, before you completed the contract to purchase it? I'd be surprised.
  • If the artist sold this as part of a course, then yes, it is not for retail and is for personal use. It is the same condition that I apply to persons coming to me, as they have to comply with the venue providers terms and condition and the material they create whilst on the premises remains subject to these conditions. I have had to get two participants to remove from their portfolios doctored images. Anyone performing at a venue is expected to be treated fairly. As they need permission and it is not a public place. Then conditions apply. Same as taking a photograph of McD’s arches are treated the same by the owner. Just because E-By allows you to pass it on at a cost, the creator of the work can also reclaim from you their loss. I would do so if it happened to me.

    As an aside, I also have to pay indemnity insurance to allow others to attend venues for training and they find this much better than college as they get to do a real job. So yes the artist is right, and he is allowed to control who gets his work. Just because google and youtube is out there, does not mean everything is free.
