Not for resale CD-ROM

I posted this message in another forum but had no response so I'm trying here.
A couple of years ago I bought a CD-ROM from a website run by an artist. The CD-ROM contained a tutorial on watercolour painting. I have since become reasonably proficient and have no use for the CD-ROM so I gave it along with several others (art tutorials) to my daughter to sell on eBay. She has been contacted by the artist and told the CD-ROM I bought was not for resale and it says so on the case and has told her to remove it from the site or he will take action. If I cannot sell it then who owns it? If the artist still owns it then what have I paid for? Can I return it and ask for (and get) a refund? There are no restrictions on any of the other CD-ROMs I gave my daughter.

Stick it on ebay with a couple of paintbrushes. Sell the brushes and include the CD-ROM as a free gift.0

There would still be consideration passing between the parties, and therefore it would still be a sale.Gone ... or have I?0
