O2 problems - looking for money

Last November my daughter received a letter from O2 saying she owed them £629 for a contract phone that was taken out in Jan 2008. Apparently it was cancelled in March 2008, but the first she heard anything was when O2 tried to take money out of her bank account via DD in June 2009, she cancelled the DD and admittedly did nothing else. Then last Nov she received the afore mentioned letter.
She knows nothing about this and told this to the person when she phoned O2 for further info. They said they would investigate and get back to her. Months passed and she received letters simultaneously from O2 and a debt collection agency.
Again she phoned and asked for more info (she requested the contract, details of phone, any calls which were made etc.) She received a statement telling her account opened...cash payment received.....account closed and amount outstanding, not what she asked for at all.
We have checked her credit report with Experian - no mention of O2 on it and we are now wondering how do we prove this debt is not hes and what exactly do O2 have to provide evidence wise to prove that it is.

Looking at the dates you've mentioned I would guess that O2 are looking to recover the balance owed on an 18 month contract which your daughter cancelled after only 3 months. I think you probably need to provide a few more details before anyone on here will be able to help you to any great extent, though. If I've helped you please show your appreciation by using the "Thanks" button

How did they get her bank details to attempt to take the DD?:beer:0

On the face of it, it sounds like someone fraudulently took out an acc in her name and its could be someone she knows if O2 have been given her correct bank info.
As soon as she saw the DD in June 2009 she should have contacted O2 to find out why they were billing her. She's now going to have to prove it wasn't her that opened the acc.
She need to get the contact info for the O2 fraud dept and send them a letter stating that she didn't open the acc and knows nothing about. She should include her dob and bank info so they can compare it with the info supplied at the point of registration. She need to also write to the collection agency stating that the acc is in depute due to fraud. Both letter should be sent recorded post.0 -
Hi everyone
Sorry I didn'treply sooner, but I have been really busy - thanks for the comments.
Just a quick update - I found a letter on MSE forum and adapted it for my daughter to send to both O2 and the DCA. The letter asked for both of them to provide evidence that the debt was hers (quoted sections of the Consumer Credit Act etc) The letters were sent recorded delivery on 2/8/10.
She received a letter from each recipient on 12/8/10 basically apologising and saying that the debt was now cleared and no further action would be taken
GREAT RESULT!:j0 -
its a service agreement, so most on here wont be appropriate. Has she checked equifax as this is what o2 used to report to back then.
Just looking back she took out a contract in jan 2008 then cancelled in march, why was it cancelled due to none payment ? If so the bal would be to the end of the contract as normaly you cant cancel past 14 days.0
