HFC PPI Reclaim with FOS

I have had my claim initially rejected by HFC bank which i expected. So I then took my complaint to the Ombudsman and after quite a few months I received a letter to state that they have upheld my complaint, yay success. But unfortunately for me HFC have appealed the decision made by the adjudicator so now I have to wait even longer :(

Has anybody experienced this response ?

    Hi there

    Sorry to hear that, but what happens now is they will move your complaint on to the ombudsman himself, you should not be waiting as long as you did when it went to the adjudicator, but its difficult to give a timescale, hopefully it won't be that long.
    And of course the ombudsman in this situation normally awards further redress on top for distress and inconvenience.

    That's good to know :) I have had another ppi claim this time with EGG and the adjudicator rejected my claim stating that I had the option to opt out of the PPI. I have appealed this decision on the grounds that I did not select this option while applying online and sent them an original aplication form for PPI which EGG sent me (not completed). They responded saying that they would look into my appeal but that the form I sent was for card protection and not PPI.

    What chance do I have of this claim being successful ?

    Hi there on the one above, your chances are still high, the ombudsman generally goes along with the adjudicators decision and within good reason on the EGG reclaim I do also think you stand a chance on this one now too, I am sure all will be okay.;)

    This is exactly the situation i'm in with HFC, HFC rejected my initial complaint, took it to the FOS who upheld my complaint and still HFC appeal to the ombudsman. So frustrating when the process started in January, to still be told they don't know the timescales. It appears HFC are trying their hardest to not pay up and to be fair it seems to be working, they have not parted with a penny of my money yet. It makes you so angry but what can you do? HSBC should be ashamed of themselves for owning this company.

    Due to the high volumes of complaints, it can take some time.


    One of mine have just been passed on to the adjudicator, and this had been with the FOS as from last October 2009, which is about right, yet others have taken even longer.

    If you in any financial hardship, do let them know, and request for fast tracking.

    Well I've now had my decision from the Ombudsman of which they have up held my claim and insist that HFC pay me £150 for distress caused to me. However the ombudsman have rejected my claim against EGG stating that I had the option to select PPI when applying for their card. Win some you lose some I guess !!!

    Well done on your HFC reclaim, Congratulations!:beer:

    Was the Egg reclaim dealt with by an adjudicator or the ombudsman himself?

    If rejected at the adjudicating stage then normally you get the chance to have it reviewed by the ombudsman.;)

    It went to the ombudsman and they agreed with the adjudicator. Don't think there is more I can do with that one. :(

    Arh I see, so it already went from that direction then.

    The only other way really, if you feel its a strong enough case would be small claims court for that one.
    I have never been that direction though - but sure some have if you want more advice on this first.
