Neighbours cigarette and bbq smoke

So from the original post the problem is that the activities are conducted on the neighbours patio which abuts the house (as is normal) and the fence, which is also fairly normal for most garden layouts.
So the problem that I see is that you have a problem with your neighbour doing anything that involves a smell on his patio.

Have just checked all the legal websites and I can confirm that it is not illegal to smoke in your own garden or to have BBQ's. You may wish to contact them by letter and inform them that doing what they wish to do in their own home is infringing on your personal rights to inform the rest of the world how to live their lives :-)0

I know I'm going out on a limb here, but could you possibly be a smoker?
OP, why not play some loud music every time that you are directly affected by the fumes from next door? For example, 'Smoke Gets in Your Eyes', on a constant loop for a few hours.
Your peaceful enjoyment of your garden is being disrupted by them so why not reciprocate? Maybe they will then start to comprehend how they are annoying you. Some people (like our friend above) have no respect for others, preferring instead to 'live and let live' totally oblivious of the hassle they are causing.
I'm a non smoker and loathe the smell of smoke , however i do have to agree with the other posters who basically say get over it . Its actions like the ones you have suggested that result in full scale neighbour disputes .

I totally agree my friend.
However, the OP stated that he/she has already tried to explain their position to the neighbour and it has been totally ignored. How is the neighbour showing 'total respect' for anybody but themselves? Surely a mutually acceptable compromise is the best way forward?
The 'live and let live' sentiment put forward on here sounds very good, but in reality is mostly a nice way of saying "let me live how I want to live and you'll have to suffer it".Marching On Together

The neighbour I assume, owns the garden and has every right to do whatever he/she chooses within it's boundaries, as long as it is legal.
A bbq or smoking in the garden is hardly a big deal.
I live in a rural location and the local farmer often spreads chicken dung on his field, now that is a nasty smell, but I accept it.
I certainly would not be posting on a forum asking people what I could do about it.0
