    Sorry to say but PP are a law unto themselves.
    As far as I am aware your money can only be clawed back within 45 days.
    I personally would NOT fund that account.
    In real terms (I may be wrong please correct me if I am) the buyer did NOT pay by Credit Card, in fact they paid by PAYPAL. PP accepted the payment - for which they charged fees - and then sent the money to you. It is PP's responsability to ensure that the card being used is genuine NOT YOU.
    If PP was a simple conduit and the money was simply passed directly to you then thats a different story. But the fact that they take the money and CHARGE for the service means that THEY are responsible, otherwise why do they charge fees?
    DO NOT fund the account. They would have a difficult job taking you to court.

    I've just had a buyer claim a chargeback for fraudulent use of her card. I added a scan of the CoP to the claim page in PayPal and nine days later they gave me the money back. In those nine days though, I did send them two emails reminding them that the CoP invokes their own seller protection and so could they hurry it up please. ;)

    Do you really only read the bits you want to read. You were advising making a fraudulent claim of non receipt. My admittedly short version of what actually happened did not involve me making any fraudulent statement at all, so I think you are confused.

    Paypal removed funds from my account yet as I fulfilled my side of seller protection they eventually, after hard work refunded me from their own pocket, nothing to do with the buyer. As far as I was concerned that was the end of it, after a period of some 6 weeks the claim for fraudulent use of a card was denied by the buyers bank (he had admitted openly to having received the goods and even admitted it to the credit card company). So the original claim was cancelled and funds returned to my account.
    Now, you may have missed this bit...I therefore got in contact with paypal and explained that I had been refunded twice (i was quite prepared to repay them one of the payments) however they sent me back one of their standard responses, assuming for some odd reason that I was a buyer , telling me i had to sort it out with the seller myself as they took no responsibility for payments made in error.

    So I made NO unthruthful statements, and indeed when I realised I had been overpaid I made a good attempt at trying to get paypal to understand what had happened.

    I think if you read my posts correctly and I assume you have reread them, it was specific numbers of packages paid for that I referred to and not the number of items received.

    It's splitting hairs though, you are still in receipt of monies you were not entitled to whether by default or not, and it's easy to say they made the mistake isn't it?

    Sorry to highjack a thread, but you say it is the proof of posting that is needed , not the tracking number. Has this changed as it used to be the tracking. Also when you do a next day delivery , you do not get a proof of posting card, just the printed tracking. Am I incorrect here and missing something

    Tracking is needed to defend an INR item not received claim. This claim can be opened up to 45 days after purchase.

    CoP is needed to defend a claim of fraudulent chargeback on card. This can happen up to 180 days after purchase.

    The reason a CoP will suffice for chargeback, as you are claiming under seller protection. This is the only document which shows you adhered to the seller protection rules, ie, posted within 7 days to the Paypal address given.
