No, you’re wrong, on the contrary he has clearly overridden the law, with impunity, as this case abundantly demonstrates. He can and clearly unmistakeably is doing exactly what he wants and he’s clearly obviously old school hardnut crim and totally a law unto himself.
tbs624 “He can apply for repossession prior to the expiry of the Fixed Term on the grounds of specific breaches by the T, but has to do so via the courts”
No, he doesn’t, he’s simply done the job himself and he clearly has no interest in or respect or need for courts. He’s clearly a can do DIY criminal and the authorities routinely universally turn a blind eye and look the other way. Government policy in UK is to let thugs get away with doing crime, as is abundantly evident everywhere all the time.
tbs624 “You should also put in a formal complaint to the police - they have to take tenants seriously in these sort of cases and cannot simply fob you off with "it's a civil matter".”
No, on the contrary, you’re entirely wrong again, that’s exactly what they’ll say and yes they do routinely fob victims off all the time, as is frequently reported in media all over UK.
There’s virtually no rule of law in UK, thugs and crims run amok everywhere all the time and nearly always get away with it, government, police and justice system have almost completely failed and it’s just dog eat dog jungle law everywhere as both the examples in this thread of thuggery in action, both the bad tenants at the start of the thread and the bad landlord at the end of the thread, unequivocably demonstrate. Citizens have to defend themselves any way that they can and might is right, there is pretty much no actual “civilisation” as such, hence monstrous savagery such as this going unpunished all the time everywhere. The Home Office recently admitted in its published material that they know that there are “1.6 million hardened full time criminals” at large running amok doing heavy evil crime continuously everywhere all the time and that there is no intention to ever arrest, imprison or deport any of the evil barbarian criminals other than the occasional token few. Government has completely abnegated its duty of care to citizens and has abandoned them to their fate, it's just universal rampant anarchy in UK. There’s virtually no human rights, justice or civilisation in crime-pays-UK. What citizens have to understand is that talk of law and justice and human rights is mostly simply bogus and hype and that in reality there is little or none of either and the weak are crushed underfoot by the strong, Darwinian style.
Unless you play by jungle rules and get redress for yourself which of course therefore necessitates lowering yourself to the same vile level as the evil sick animal savages that you’re up against. Is it worth it? Is it your cup of tea? Personally I don’t bother, it’s not worth it and it’s not my cup of tea. I just avoid conflict and don’t precipitate it and I give thugs a wide berth and keep out of their way and I generally only go head to head with them if I’m cornered and there’s no other way to escape.
Thanks for your thoughts MC. Fully aware of how those "in authority" can sometimes fob people off, how thugs behave etc. Most readers of the thread will understand that my comments reflect the law.
I would agree with you that police officers can sometimes be less than helpful: however there are sources of help and professional advice available to Heelixx
You clearly have a specific outlook on life, honed no doubt by your own difficult experiences, but in several threads your posts appear as little more than a rant against the world, designed to send any OP straight down to the pits of despair.
As G-M says, not helpful.0 -
Print this page off and take it to the police officers dealing with your case
Can you afford a solicitor? If not, do you qualify for legal aid? You need legal advice.
I'm sorry this is happening to you, and good luck.
Hi Sebb,
(Had to delete your link as newbies cant use them) in reposts that is.
In answer to your question, Yes i qualify for legal aid & am now seeking someone to represent me or at least look at my case as there seems to be many clauses broken by the LL + the charge of Affray which he has blatently lied to the Police to get let off on Bail for the moment.
Thnx for the support
p.s. I bookmarked your link, i forgot to mention it before.0 -

It's good to see you asserting your rights like this. You've been treated very badly and the only way this kind of behaviour will stop is if people like you follow through on it. This forum will give you plenty of support and advice. Please keep us updated, because it will help other people in your situation. Too many people just walk away from this kind of situation and cut their losses. I wish you the best of luck and please don't let this slime get away with this.0 -

Do read it through, especially the appendices/roleplays section, so that you can have confidence in dealing more firmly with police officers who simply tell you that problems such as these are a civil matter. They categorically are not. Tenant harassment and illegal eviction are *criminal* offences.
Once you have a legal adviser in place, ask them to take this up on your behalf with the police, at the same time as sorting out the tenancy issues.
The licensing authorities should also be made aware of pub LLs who act in this manner - am assuming the pub license is in his name?0 -
The same link is in post 59 Heelixx

The Pub License is in his name, I had to delete it from my original post, think that was for legal reasonsbut thanks for people picking me up on that.
I've asked each Authority for direction to legal advice & it's been . . . well . . . . flimsy !
As you can see I'm not an uneducated man by any means but . . & there is always a but. . . The Law is a very difficult thing for your average Citizen like myself.0 -

Tbs624 “but in several threads your posts appear as little more than a rant against the world, designed to send any OP straight down to the pits of despair.”
On the contrary, my posts are realistic and practical and I highlight possible ways forward and I illuminate the possible pitfalls and downsides of action and inaction, I get to grips with the subject and I mostly don’t just suggest airy fairy head in the clouds unrealistic idealistic stuff such as why don’t you try to get redress through the courts - and on the occasions when I do highlight that court might be an option I point out the possible pitfalls and inadequacies of that approach. No, you do me a grave disservice to suggest that my motivation is negative or that I design posts to give people despair, what an awful nasty accusation, on the contrary, I suggest helpful solutions to consider and I try to make people in trouble aware of important things that they probably should be aware of and that might help them if they take it on board. No, as I said, your suggestions that a thug is subject to law are incorrect and are clearly manifestly untrue in this instance and you should acknowledge that rather than now simply casting aspersions and making slurs. That’s a very poor response to having your incorrect suggestions contradicted and explained. Shame on you. I’ll accept an apology if now reading this correction to your attitude you’re sentient and civilised enough to do so – however, if you continue with this line, well, you’re wrong.0 -
Yes, shamefully stolen from your post
. Should have given you credit, sorry.
Sebb wisely made the additional suggestion of printing it off to assist you in dealing with police officers who may be lacking in their understanding of LL& T issues0 -
Sorry - my reply wasn't about that, have previously posted the link in another thread about another LL and it's always good for any knowledge/ links to be passed on by any posters, so no question of "stolen": I simply misread your comment about newbies and accessing links.

Hi tbs & sebb,
Just finished reading the links provided & am now working my way through Sec 6/7 Criminal Law Act 1977. I shall & will print this out & put it with my plastic bag of paperwork concerning this whole fiasco.
It was very interesting to read & find new clauses that have not been adhered too, by relevent authorities & LL alike. Minefield is the term I'm going to use at the moment.0
