    He needs to join, as a matter of urgency, a good landlords association such as RLA, they will be able to advise on the options available and how best to proceed. To be honest, he's been a muppet and needs to do a bit of damage limitation if things are as bad as you describe. Has he not even spoken to the friend whos daughter lives in his house?

    Your friend is out of his depth here. Being a landlord is not for the amateur. He really needs to start reading up on this on the many threads on MSE and landlordzone.

  • yes he spoke to fiona but she said shes washed her hands of her daughter - he told her what he belives is happening to his house ans she said sorry but will not get involved. i will google rla thank you :-) can he get in touch with the court himself to get them evicted?

    This really sounds like he is well out of his depth.

    Someone needs to look at the agreement to see if its even legal and work out how he can give notice.

    NO ONE can get a tenant out without a court order.....

    Your friend obviously knows nothing about being a LL - tell him to join National Landlords Assocation on monday - 02075 828 171 (joining fee is tax deductible) - they have a great legal helpline which can tell him exactly what to do to get this tenant out..... there is a lot of paperwork involved and further costs - £150 court application fee and £95 baiilffs fee.... and it will take several months...

    if you dont do this.. you will never get him out with just forum help.. and if you go to a solicitor it will cost you many hundreds of pounds....

    The court is for the issue of proceedings. Your friend must complete the court forms and then there will be a hearing. BUT the forms must be completed properly and even if everything is correct, a hearing might be many months away. There is no guarantee that a court will give an order for possession.

    Your friend really really needs professional advice.

    Perhaps if your friend isn't confident enough to deal with the paperwork to get his property back (notice to quit and possibly court order and then possibly bailiffs) he should consider Landlord Action. They offer fixed fees for each step of the eviction process.

    Did your friend draw up an inventory/schedule of condition, signed by the tenants? How much rent do they owe - one month, two months?
  • i am so sorry for him - when his mum died he just could bear to sell it so as hed know fiona for 20+ years he thought it would be ok to let her daughter have it he only charged £400 per month wich is really cheap. he printed off an agreement off the net and they moved in. when he saw the bath panel - well you can imagine ever since he has tried to contact them and they refuse and now the kitchen cabinate doors are in a pile. if the police could just go with him to see how much damage there is i think it might help but he has no idea how to get in touch with the courts
