Does anyone at the BDC know what they are doing?

Today i have recieved a letter to state my 14yo son is entitled to DLA on both lower rates. This is due to him self harming and having depression etc.
So the first thing you are told to do is notify all those whom you are in receipt of benefit from for the change in circumstances. So i ring up ESA - have been receiving sick notes from the GP for stress and depression caused by my sons behaviour. They tell me in one breath im entitled to claim income support but in the next i have to stay on ESA. I appreciate i wouldnt get carers allowance given the lower rate care component but should i stay on Esa (medical pending) or be moved on to anything else? Is their anyone out there that knows whats what?

where do you see yourself in 6 months?

if your stress and depression is only because of your son, it might pass and you might not qualify for esa anymore.

if youve always had depression then stay on esa as it's more money i think than income support after youve had the medical and passed (assuming you do)
2 esa medicals passed successfully (support group - it can be done!!)!! :j

The GP has put depression on the sick note but i also have low grade psoriatic arthritis and plantar fasciitis which give daily problems.

TBH i dont think in 6 months time the issues with my son would reside as over the past 18 months they have become worse on a daily basis.

Im confused to be told on the phone in one breath i should be claiming income support and in the other to stay on ESA. The money difference is neither here or there its whether im claiming the right thing in the first place as i dont want to get a few months down the line to be told i were on the wrong benefit and have to pay back the extra.

Why would you be entitled to income support? Or are you a lone parent with a child unde 10?

  • Maybe that's why they said she has to stay on ESA.

As your son is only on Lower rate care, you won't be entiled to apply for carers allowance for him, he would need to be on middle rate care. I'm guessing thats why and where the conflicting evidence is coming from.

If your on sick notes (still call them that), then you would be in the ESA side of things not job seekers allowance.

If things changed with your son and he was awarded middle rate care, you would then come off ESA, and would go onto carers allowance (think is currently £55.00 pw), then the income support would kick in to top the ESA up.

Its one option that I may need to look into when dd becomes 8 - In Oct the age reduces to 7 for children of single mothers to no longer be able to claim IS, - either JSA or ESA. My lone parent advisor suggested as my mum is disabled and on middle rate care, I become her carer, - get the carers allowance etc (as above), but if I went down that line she would lose an element of her middle rate care - to contribute towards the carers allowance.

    Its an absolute mindfield.

But good luck with it all, if I can help just pm me. x

The ages have reduced from the child being 16 to 12 last year and coming to 7 this year, then the next change will be the child be 3, so the single parent would only be on income support whilst their child is under those age groups xx

Surely the most suitable option would be to get a job?

The next change after October is when the child is 5 - not 3.

Do you care for your mum 35 hours or more per week?

You mother wont lose any of her DLA but she would lose the SDP off her IS but when you need enough care to need a carer 35 hours or more per week you need the care and so the loss is acceptable, you couldnt pay for much care from an agency for the @£60 per week SDP (forgive me if the ammount is wrong but Ive never claimed IS and my knowledge of the ammount comes from this site)
