Exchange possible at phones4u??

I recently signed a contract for an Iphone 4 at a local store in Liverpool Paradise street. It was around 4.50pm so the store was about to close soon. I had previously popped in and spoke to the manager and asked for a price plan quote with regards to a iphone 4 32GB. Having nipped around I decided to finalise the deal.

The sales assistant who served me asked me what I was looking for. I told him specifically that I was looking for a Iphone 4 32GB and that I'd like some quotes. He gave me the tariffs for £40+ on a 24month contract. I told him that I was looking for a 18month one on a £35 contract. He told me Vodafone didn't do it...however I reassured him that Vodafone did do it since I nipped into they're official branch earlier. He asked me what price they were offering for the phone and I told him that I wasn't sure (probably around £220? Couldn't remember). Mike then quickly told me that he'd match the deal so I thought I'd save the hassle. Whilst preparing the documentation he told me that if I don't buy insurance he is unable to sell me the phone. I refused so wanted to cancel the negotiation. He then told me he would sell me the phone for £170 if I signed up for 3months insurance. I thought I was ludicrous so again refused. Eventually Mike ended up finalising the deal selling the phone to me at £170. At the time I thought I was in for a real bargain.

However it wasn't until I signed all the papers and given the box did I realise it was an Iphone 4 16GB. I brought this up to the sales assistant Mike Bruce and he denied the fact I requested a 32GB. Infact he even lied saying that the store doesn't have any 32GB when John (the manager) earlier indicated that there was indeed 2 on Vodafone in stock. Annoyed I quarrelled with him for abit and was just told to come back the next day.

I'd like to know, as a customer what are my rights? Am I able to exchange and pay for the difference in handset models? If not am I able to terminate the contract and start from scratch?

    the best thing to do would be to ring the phones 4u customer service team as what they are able to do instore is locked by head office and they would need authorisation! if you went instore they would just put u thru 2 head office (plus u will have more luck gettin a result speaking to them than someone instore)
    the amount of iphones places are gettin are not only dependant on deposits but how much money they will generate the company!
    for example using the prices you have given.... a store who sells 3 iphones on 24m £45 with insurance will make for instance £840 whereas a store that sells 6 iphones on 18m £35 with no insurance will make £300
    im not saying this was the case with where you went im just tryin to give you an idea of why he may have said the tarrif didnt exsit (even thou tarriffs are set by apple) and said you have to take out insurance to get the phone (against fsa regulations)

  • Thanks so much for your help. Yeh it makes perfect sense. I think I will give the head office a call tomorrow and see if anything could be done. If not guess I'll just have to make do with 16GB ;) Thanks again for the quick response!!
