Car Deposit - I want a refund

The car is £30k and has done 12,000 miles when I viewed it.
Now the garage have had it, though they cant fix the problem, have been using it for their own transport as its now reading 12,493 when I last checked up on them.
put it this way, the car would not pass an MOT with this issue, not that it needs one for a while. also i spoke with trading standards and they said a guideline is 14 days, if the garage cant fix it then im entitled to my deposit back. plus the extra mileage is breach of contract0 -

Breach of contract means you can get your money back
Actually, given the technical ability of the garage together with their customer service standards I’d be very wary of dealing with them anyway.
If they treat you like this now what is the service going to be like if you get another problem two months down the line after they have all the money?0 -
Small update.
I have yet to pay in full for the car or collect it.
However the dealer I bought it off has now phoned up and said it needs various suspension parts but dont worry its under warranty. while the car drove fine (it was the only one i have driven so hard to tell), i dont doubt his claims.
the car in question is a specialist rare and it had its first suspension rebuild at 3,000 miles...
with this new info, can i reject the car on the ground its not suitable for sale and get a FULL refund? i havent even paid for the car in full yet and its doing my head in, i just want out.0 -

Thats not what consumer advice told me, they said leaving a deposit is as good as signing paper because it shows the intent is there.0 -

Well consumer advice is wrong. It'd get thrown out of Court if you ever went that far.
As long as you have nothing that says !invoice" on then there is nothoing that you can do.0 -
A contract doesn't need to be a written one to be enforceable.0
