Car Deposit - I want a refund

2 weeks ago i went to view a car, it had a few faults but as it was under warranty the independant dealer sent it to the manufacturers dealer to be repaired.

i called the indepent dealer that afternoon, and left a deposit over the phone by debit card, 10%, so £3000. i have not signed anything, everything was done verbally.

however, the dealer, 1 week on, still hasnt fixed it, and the car now has an extra 300 miles on it from when i viewed it. i was told the car would be fixed the same day, as i viewed it in the morning and they had the part in stock.

now i want out and i just want my money back. ive yet to speak with the supplying dealer, but im guessing they will tell me to get lost, so im after some ammunition.

please advise

SORRY JUST REALISED I SAID DIRECT DEBIT, I MEANT DEBIT CARD

    Maybe you should have left a deposit once it was fixed and you could satisfy yourself?

    My initial thought, but 300 extra miles taking the mick a bit.

    Not really. Depends entirely where the nearest dealer was and if its had to go back and forward a few times.

    300 miles on a 3k car (bearing the age and mileage it will be) is immaterial.

    Is the car £3,000 or is that the deposit?

    If the £3,000 was paid by direct debit what about the direct debit guarantee scheme?

    Oh you are quite right. I still doubt 300 miles is material unless the mileage was under 5k initially; as for the next bit it will not be a direct debit. The DD scheme isnt for one off payments.

    I thought it was odd to use a DD in these circumstances but it is what the OP stated in his original post. maybe Debit Card??

    We've often had to put serious mileage on cars that were getting ready for one reason or another. all depends wha the fault was, how often it shows up, how far away the right people are with the machines etc...

    can we clarify is this a £3k car or (as the in the OP) a £3k/10% deposit so a £30k car?

    I read it as the deposit being £3,000. It'd be a pretty crappy car if the whole price was £3,000 and it was new enough to be still under warranty?
