1 Year tennancy agreement end on the?

Hi,

I am renting and took out a contract on the 27/08/09 and the contract is for 1 year (not 12 months not x days)

Hence my move out date is on the 27/08/10 I said.

However the agency send me a cheeky email today saying that I need to move out on the 26/08/10

Who is right? Me I hope?

    1 year is 365 days and we do not have a leap year. I would understand why I need to vacate the flat on the 27th but 26th? Why?

    The 27th was day 1 (not day 0 as you assume). Count the days on a calendar. You will find the 26th is day 365.

    Quite simple really.

    A year, 365 days, 12 months, 52 weeks, call it what you like, only has one 27th of August in it.

    If you occupy the property for any part (even an hour) of two different 27ths of August, then you have been there for more than a year.
  • I work with PCs way to much :) (my job) hence I did start the 27th of August as day 0 with the date calculator I used :rotfl:

    Thanks, god to know my previous landlord got this wrong though :)

    They are correct, not you. As others say the starting date was the 27th so you would have to be out on the 26th.
    If you look on your contract (tenancy agreement) it should state the move in date and the move out date after the term of the contract. It would state 27th August 2009 - 26th August 2010. Unless you ask to stay they will usually assume you leaving on the move out date.
    To stay till the 27th would be 1 year and one day. You would have to pay for another month in that case as it would go on to a rolling contract.

    To stay till the 27th would be 1 year and one day. You would have to pay for another month in that case as it would go on to a rolling contract.
    Actually you'd have to pay for 2 months since you would have created a periodic tenancy which requires one months notice ending on a rent day. Even if you gave notice immediately sept would be less than a month so you'd have to stay till 26 Oct !

    Yes, but giving notice on the 27th wouldn't kick in until the next rent day, hence 2 months minus one day.
