  • So I should just ignore it all? Or send another letter, referring them to my previous correspondence?

    Might give me another 18 months of trouble free post and phone calls...

    You could, but don't send them a copy of the previous request for the agreement.

    If they haven't satisfied your request, or haven't provided it in full, then that's their job to chase up, not for you to do their job for them.

    How many letters have you received from HFO so far?

    I mentioned before about referring every single breach to the OFT, which still applies, but I'd also register complaints to the Financial Ombudsman Service (FOS) - about each letter, citing your reasons why.

    The reasons why I suggest that is because it costs HFO £500 a time for any complaint you raise through the FOS, if the FOS chooses to investigate your complaints. I see no reason why they shouldn't - they're breaching a number of OFT guidelines, and are adding charges on at will.

    "Unbelievably, it was clearly a fake as the logo at the top was blatantly scanned in" - Whaaaaaat???

    "Despite my name and address being at the top of the letter, it began 'Dear Mr Brougham' and thats not even my name!!!" - A Data Protection breach then. File a complaint with the Information Commissioners Office, just for this lapse.

    OK, today I received this letter from them, hmm, quite interesting, will see what happens, I won't be calling them to see at what stage they are to.

    Now that they've sent that letter, any further collection activity on HFO's part (or anyone else's) should be referred to the OFT, FOS and others whilst the request remains in default.

    It also means they've admitted receiving your CCA request - you need do nothing else for now.

    Apart from that one, purely out of spite, it's worth citing each and every letter (as separate complaints, of course) to those bodies anyway.

    Besides, that letter tries to buy them an extra couple of days - they knew when the 12+2 days ran out, so they're being disingenuous and misleading.

    I'm also having the same issues with HFO. They contacted me 2008 and harrassed me for about a month. I've sent off the CCA and SAR to them and Barclays and recieved no response from both. Until, exactly a year later HFO sent me copies of my statemets. Is this what a CCA is? Still nothing from Barclays.

    I acknowledge debt owed to Barclays and want to pay it off - even to HFO but I refuse to pay the money they want 1177pounds. Original debt with Barcalys was around 800 -- this I had a problem with because I lost my job and Barclays continued to charge me interest, late payment, even payment protection (can you believe it?) -so around 35% if not more of that (800) were interest and others fees.

    I'm not worried about going to court as I am abroad, so HFO won't even pursue it and won't be back in the UK for a long while- so not so concerned about Credit report. I just don't want to be ripped off. Please advice..

    Hi Fribourg,
    As HFO have not complied with your CCA request, send the in-dispute letter to them and with-hold payments until such times as they comply and from a 1996 CC, I bet my entire months supply of ciggies that it will not be enforceable.
    No need to send in any reminder, they know the law, cca1974 clearly states that if they are collecting for a creditor then s175 applies, if they own the debt s189 applies.
    As to telephoning them, DON'T! they will lie, cheat, bully and intimidate you, keep everything in writing.
    The law though does state that even though the debt is unenforceable, if the cc company has not issued a default, then HFO can and they can also continue collection activities so expect more scarey threatograms in the future.
