Write instead to Silverstone and complain that one of their marshalls deliberately directed you to a field where everyone would be ticketed by Vinci and enquire if they were aware of this.

Apparently over 1000 fines were issued. This just goes to show what a money making trap this is.

Is it really true that these fines are not legally enforceable?

I am writing to Vinci outling their failure to provide prominant notices and also that marshalls' non disclosure of permit requirement.

I am planning to start an action group if I don't get a satisfactory response from Vinci.

They're not enforceable precisely because they are NOT fines.

Vinci don't give a toss and will have a good laugh at your letter because they know more about the scam than you do.

    Just ignore them.
  • I also got a fine at Silverstone from Vinci. I ignored it on advice. The actual ticket put on my window was not dated (don't know if this is relevant).

I asked a barrister who advised she did not even know what a Civil Parking Notice meant and said you should be okay to leave it.

Anyway I have recieved a letter in the post yesterday from Vinci saying I must pay £60 within 28 days failure in which Civil Proceedings may be issued and the fine passed to a debt collecting firm who will add on their costs?

Any advice? Shall I still just leave it? They must have got my details from the DVLA to get my address?

DVLA provide these scammers with your address in return for a fee of £2.50. This does not make their charges legitimate. Civil proceedings MAY be issued and West Ham may qualify for the champions league. Both are unlikely. The letters are designed to scare you into paying but are really toothless threats. Ignore and put the money to better use.
Still waiting for Parking Eye to send the court summons! Make my day!

The operative word is 'MAY' which means nothing, I may win the lottery next week, do not acknowledge them or make any contact. As for a debt collecting firm, they have no more powers than you or I, if they contact you ignore them completely and if they make any threats tell them you will report them for harassment.
  • I have the letter here and it reads -

Notice to Owner - the driver who left the vehicle in a parking space at Silverstone Race Circuits on 10th July 2010 was served with a Civil Parking Notice.

The outstanding amount of £60 must be paid no later than the last day of the period of 28 days beginiing with the date this notice.

Please be advised that if the outstanding sum remains unpaid or a challenge is not recieved by the last day of the period of 28 days beginning with date of this notice, civil proceedings may commence against you via a third party debt collecter, who will add their administrative costs to the outstanding sum.

At the bottom of letter it says

Registered in England No: 2362957 at Oak House, Reeds Crescent, Watford, Herts, WD24 4QP
    VAT Registration: 653 5517 31

I deal with Civil Litigation and the issue fee for a Small Claim is £30.00!! It's just not worth it!

For them to issue they need to ensure they are issuing against the correct Defendant if not then those proceedings are defective (means 100% nothing) which means the waste of an issue fee.

I am thinking I will let them issue against me... file a Defence saying I was not driving the vehicle therefore case of mistaken identity therefore no case..... if they was to issue they must prove on the balance of probabilities (51%) that it was me and on the basis they don't know what I look like I can't see that being proven!

The chances of them issuing anything except steam(cos you won't pay) are remote in the extreme.Sorry to spoil your fun.

I know that county Court cases don't set a precedence, but after that court case last week, where a judge said that the £50 demanded was excessive, then asking for £60 is even worse.

    The letter is utter tripe.
    Very safe to ignore.

But its contents do further my view that that Fraud and conspiracy to defraud are involved.
  • I went all three days. Friday and Saturday no sign of a problem, but when I got back to the car on Sunday there was a ticket under the windscreen wiper. Yesterday two letters arrived, one for Saturday and one for Sunday.

The reason I parked there in the first place was because I have done so in the past. I think that the last time was 2006, it seems that the circuit may have changed it's policy since then. It should have been made obvious.

I found the sign about parking in the end. It was just outside the entrance, on the left hand side. There was a sign immediately above it warning about ticket touts! It was also partially obstructed by the five bar gate that closes the entrance. So as you approached the entrance and were being waved in you would not see it. Even if you did there would be no time to read anything other than the top notice.

Anyway, I intend to ignore the letters (which were to my wife as she is the vehicle keeper). I expect to hear more, probably from debt collectors. We will not disclose who the driver was, in the extremely unlikely case that they took my wife to court her defence would be that she was not the driver.

If you intend to complain to Silverstone Circuit then include me.
